ואמר רבה זרק כלי מראש הגג והיו תחתיו כרים או כסתות בא אחר וסלקן או קדם וסלקן פטור מאי טעמא בעידנא דשדייה פסוקי מפסקי גיריה

And if a man lie not in wait,<span class="x" onmousemove="('comment',' Ex. XXI, 13. ');"><sup>28</sup></span> excludes a case where there was intention to throw a stone to a distance of four cubits, but which fell at a distance of eight. Regarding [the release of] a slave the difference of opinion between R. Simeon b. Gamaliel and the Rabbis<span class="x" onmousemove="('comment',' V. supra p. 137. ');"><sup>29</sup></span> still applies. Rabbah again said: In the case of one throwing a utensil<span class="x" onmousemove="('comment',' Belonging to another. According to the interpretation of Rashi a.l. the utensil was thrown by its owner; cf. however, Rashi, supra 17b. ');"><sup>30</sup></span>

Tosafot on Bava Kamma

The previous person removed it. - The explanation of Rav Alfas of Ravah and goes with his reasoning, that hat he says he is obligated in Garmi (Later on page 98.) And to the Ree it appears that in this case it is Grama of damages and everybody agreed he is exempt.
