אמרי הכי השתא התם שלא ברשות לא קביל עליה נטירותא הכא ברשות קביל עליה נטירותא
and the payment would have to be for full damages, whereas in the absence of permission it would amount to Horn doing damage on public ground,<span class="x" onmousemove="('comment',' I.e. on premises where the plaintiff has no more right than the owner of the ox, the defendant. ');"><sup>4</sup></span> and the payment would accordingly be only for half damages.
