היכי משתבע אמר רבא שבועה שלא בכוונה שברתיה ואתא ר' יהודה למימר שומר חנם ישבע נושא שכר ישלם האי כדיניה והאי כדיניה ואתא ר' אלעזר למימר אין גמרא כר"מ ומיהו תמיה אני אם יכולים זה וזה לישבע
