ואמר רב חמא בר גוריא אמר רב הלכה כר"ש ומאן פליג עליה ר"י והא אמרת רבי יהודה ור"ש הלכה כרבי יהודה
R'Jose ruled: [The share of] a gentile imposes restrictions,<span class="x" onmousemove="('comment',' Since he might return on the Sabbath and thus assert his rights to the use of the courtyard.');"><sup>11</sup></span> but that of an Israelite does not impose any restrictions because it is not usual for an Israelite to return on a Sabbath.<span class="x" onmousemove="('comment',' As he is not likely to return before the termination of the day his house may be regarded as ownerless and the courtyard thus remains at the entire disposal of the other residents.');"><sup>12</sup></span> R'Simeon ruled: Even if he left his house<span class="x" onmousemove="('comment',' On Friday before the Sabbath had begun.');"><sup>13</sup></span>
