והשתא דאמר רב אשי דקיימא לן זה נשבע שאינה ברשותו וזה נשבע כמה שוה הכי קאמר מי נשבע תחלה מי שהפקדון אצלו שמא ישבע זה ויוציא הלה את הפקדון
