דתניא (ויקרא ה, יז) ואם נפש וגו' לחייב על ספק מעילות אשם תלוי דברי רבי עקיבא וחכמים פוטרין מאי לאו בהא קא מיפלגי מר סבר למידין ומר סבר אין למידין
