אגב חורפיה לא עיין בה

בעי רמי בר חמא אבי האב ואחיו כגון אברהם ויעקב בנכסי עשו איזה מהן קודם אמר רבא תא שמע האב קודם לכל יוצאי יריכו ורמי בר חמא יוצאי יריכו שלו ולא יוצאי יריכו של בנו

father and his<span class="x" onmousemove="('comment',' Of the deceased. ');">⁴</span> brother as, for example. [the claims of] Abraham and Jacob upon the possessions of Esau, who takes precedence? — Raba said: Come and hear! A FATHER TAKES PRECEDENCE OVER ALL HIS DESCENDANTS.<span class="x" onmousemove="('comment',' Hence the deceased father's father takes precedence over the deceased brother who is also a descendant of his. ה"נ מסתברא דקתני זה הכלל כל הקודם בנחלה יוצאי יריכו קודמין ואילו איתיה ליצחק יצחק קודם השתא נמי דליתיה יצחק יעקב קודם שמע מינה:

Logical reasoning [leads to] the same [conclusion]; for it is stated, THIS IS THE GENERAL RULE: THE LINEAL DESCENDANTS OF ANY ONE WITH A PRIORITY TO SUCCESSION TAKE PRECEDENCE. If, [then,] Isaac<span class="x" onmousemove="('comment',' The father of the deceased. ');">⁸</span> had been [alive], Isaac would have taken precedence.<span class="x" onmousemove="('comment',' Being the nearest heir. ');">⁹</span> now, also, that Isaac [himself] is not [alive], Jacob<span class="x" onmousemove="('comment',' The brother of the departed, being a lineal descendant of Isaac. <big><strong>מתני׳</strong></big> בנות צלפחד נטלו ג' חלקים בנחלה חלק אביהן שהיה עם יוצאי מצרים וחלקו עם אחיו בנכסי חפר ושהיה בכור נוטל שני חלקים:

');">¹⁴</span> [WHICH CONSISTED OF TWO], SINCE HE<span class="x" onmousemove="('comment',' Zelophehad.
