Bava Batra 278
והיורש את אשתו
and that [which a husband] inherits [from] his wife!<span class="x" onmousemove="('comment',' This clearly proves that a husband is regarded as heir. For had he been regarded as a buyer of the property that was brought to him by his wife, he would have retained that status even after her death; and all her landed possessions, as all landed property bought, would have had to be returned in the Jubilee year to their original owner. ');"><sup>1</sup></span> Raba said to him: And now that he did send [his letter] do we know [this]?<span class="x" onmousemove="('comment',' V. note 2. ');"><sup>2</sup></span>
אמר ליה רבא והשתא דשלח מי ידעינן האמר ר' יוסי בר' חנינא באושא התקינו האשה שמכרה נכסי מלוג בחיי בעלה ומתה הבעל מוציא מיד הלקוחות

אלא אמר רב אשי בעל שויוהו רבנן כיורש ושויוהו רבנן כלוקח והיכא דטבא ליה עבדו ליה גבי יובל שויוהו רבנן כיורש משום פסידא דידיה גבי דר' יוסי בר' חנינא שויוהו רבנן כלוקח משום פסידא דידיה גבי דרבין משום פסידא דאלמנה שויוהו רבנן כיורש
it was ordained [that if] a woman had sold during the lifetime of her husband, usufruct property,<span class="x" onmousemove="('comment',' Property which belongs to her, while the right of usufruct is enjoyed by the husband, v. p. 206, n. 7. ');"><sup>5</sup></span> and died, the husband may seize them from the buyers?<span class="x" onmousemove="('comment',' Which proves that a husband has the status of a buyer. An heir could not seize property sold. ');"><sup>6</sup></span>
והא גבי דר' יוסי בר' חנינא דאיכא פסידא ללקוחות ושויוהו רבנן כלוקח
— But, said R. Ashi, the Rabbis have given a husband the status<span class="x" onmousemove="('comment',' Lit., 'they made him'. ');"><sup>7</sup></span> of an heir and [also the status of] a buyer; and whichever was better for him they gave him.<span class="x" onmousemove="('comment',' Lit., 'and they did as it was better for him'. ');"><sup>8</sup></span>
התם אינהו אפסידו אנפשייהו כיון דאיכא בעל לא איבעי להו למיזבן מאיתתא דיתבא תותי גברא:
In respect of the Jubilee year, the Rabbis gave him the status of an heir, in order [to prevent] loss to him.<span class="x" onmousemove="('comment',' That he shall not be compelled to return what he inherited from his wife to her family. ');"><sup>9</sup></span> In the case of [the statement of] R. Jose b. Hanina, the Rabbis gave him the status of a buyer [also] in order [to avert] loss to him.<span class="x" onmousemove="('comment',' So that he shall be entitled to seize the property from anyone who bought it. ');"><sup>10</sup></span>

In respect of [the statement of] Rabin, [however], in order [to avert] a loss to the widow, the Rabbis gave him the status of an heir.<span class="x" onmousemove="('comment',' The husband's undertaking to provide for his wife's maintenance preceded the marriage. מתני׳ <big><strong>מי</strong></big> שמת והניח בנים ובנות בזמן שהנכסים מרובין הבנים יירשו והבנות יזונו נכסים מועטין הבנות יזונו והבנים ישאלו על הפתחים אדמון אומר בשביל שאני זכר הפסדתי אמר רבן גמליאל רואה אני את דברי אדמון:
loss, the Rabbis had yet given him the status of a buyer!<span class="x" onmousemove="('comment',' Why were not the interests of the buyers taken into consideration as much as those of the widow? איתמר נמי כי אתא רבין אמר ר' יוחנן ואמרי לה אמר רבה בר בר חנה אמר רבי יוחנן כל שיזונו מהן אלו ואלו עד שיבגרו הן מרובין פחות מכאן הרי אלו מועטין
they should not have bought from a woman who is subject to a husband's jurisdiction.<span class="x" onmousemove="('comment',' Lit., 'who dwells under a man', i.e., whose property is subject to the claims of a husband to whom it will finally pass over after her death. These buyers contrived to deprive him of his right by purchasing the property during her lifetime, hence they must stand the loss. ');"><sup>17</sup></span> <b><i>MISHNAH</i></b>. [IN THE CASE OF] ONE WHO DIES AND LEAVES SONS AND DAUGHTERS, IF THE ESTATE IS LARGE,<span class="x" onmousemove="('comment',' Lit., 'possessions are many'. ');"><sup>18</sup></span>
ואי ליכא לאלו ואלו עד שיבגרו
THE SONS INHERIT [IT], AND THE DAUGHTERS ARE MAINTAINED [FROM IT].<span class="x" onmousemove="('comment',' Until they marry or become of age. ');"><sup>19</sup></span> [IF] THE ESTATE IS SMALL, THE DAUGHTERS ARE MAINTAINED [FROM IT], AND THE SONS SHALL GO BEGGING.<span class="x" onmousemove="('comment',' Lit., 'begging at the doors'. ');"><sup>20</sup></span> ADMON SAID, 'AM I TO BE THE LOSER BECAUSE I AM A MALE!' R. What is considered a large estate?<span class="x" onmousemove="('comment',' Lit., 'and how much (are) many'. ');"><sup>22</sup></span> — Rab Judah said in the name of Rab: Out of which both<span class="x" onmousemove="('comment',' Lit., 'these and these', the sons and the daughters. ');"><sup>23</sup></span> may be maintained for twelve months. When I recited this before Samuel,<span class="x" onmousemove="('comment',' When, after the death of Rab, he joined for some time Samuel's academy. ');"><sup>24</sup></span> he said, 'This is the view of R. Gamaliel b.
