Chapter 9

א ונתקלקלו הלוים בשיר התקינו שלא יהו מקבלים את העדים אלא עד המנחה
1 and the Levites got confused in [the daily] song. [So] they decreed that they would not receive the witnesses except before Minhah;
ב ואם באו עדים מן המנחה ולמעלה נוהגין אותו היום קדש ולמחר קדש
2 and if the witnesses came from Minhah and later, they would make that day holy and the next day holy."
ג אמר רבה מתקנת רבן יוחנן בן זכאי ואילך ביצה מותרת דתנן משחרב בית המקדש התקין רבן יוחנן בן זכאי שיהו מקבלין עדות החדש כל היום
3 Rabbah said: "Since the decree of Rabban Yohanan ben Zakkai, an egg [laid of the first day of Rosh Hashanah] should be permitted [on the second day] – As it is taught [in a Mishnah]: 'Since the Temple was destroyed, Rabban Yohanan ben Zakkai decreed that they would receive testimony of the month [of Tishrei] all day [on the 30th of Elul].'"
ד א"ל אביי והא רב ושמואל דאמרי תרוייהו ביצה אסורה א"ל אמינא לך אנא רבן יוחנן בן זכאי ואת אמרת לי רב ושמואל
4 Abaye said to him: "But Rav and Shmuel both said that the egg is forbidden?!" He said to him: "I am saying to you Rabban Yohanan ben Zakkai and you are saying to me Rav and Shmuel?"
ה ולרב ושמואל קשיא מתניתין לא קשיא הא לן והא להו
5 But for Rav and Shmuel, our Mishnah is a problem! No problem: this [Rav and Shmuel] for us [in Babylon]; this [Rabban Yohanan ben Zakkai] for them [in Israel].
ו ורב יוסף אמר אף מתקנת רבן יוחנן בן זכאי ואילך ביצה אסורה מ"ט הוי דבר שבמנין וכל דבר שבמנין צריך מנין אחר להתירו
6 And Rav Yoseif said: "Even from [the time of] the decree of Rabban Yohanan ben Zakkai and forward, the egg is forbidden; what's the reason? It [the original decree] was a matter [decided] in a vote, and any matter that was [decided] in a vote needs another vote to permit it."
ז אמר רב יוסף מנא אמינא לה דכתיב (דברים ה, ל) לך אמור להם שובו לכם לאהליכם ואומר (שמות יט, יג) במשוך היובל המה יעלו בהר
7 [As] Rav Yoseif said: "From where do I say it [this principle of voting]? As it is written, 'Go, say to them: return to your tents' (Deuteronomy 5:30); and it says, 'With the sound of the horn, then you may ascend the mountain' (Exodus 19:13).
ח (ותניא) כרם רבעי היה עולה לירושלים מהלך יום אחד לכל צד וזו היא תחומה (עלת) מן (הצפון) ועקרבת מן (הדרום) לוד מן המערב וירדן מן המזרח
8 And as it is taught [in a Mishnah]: 'Fourth [year produce] of a vineyard: he used to go up to Jerusalem walking from one day [away] from all sides [of the city], and this was its border: Eilat from the south, Akravat from the north, Lod from the west, and the Jordan from the East.'
ט ואמר עולא ואיתימא רבה בר בר חנה א"ר יוחנן מה טעם כדי לעטר שוקי ירושלים בפירות
9 And Ula (and some say Rabbah bar bar Hanah said that Rabbi Yohanan Said): 'What's the reason? In order to adorn the markets of Jerusalem with fruit.'
י ותניא כרם רבעי היה לו לר' אליעזר במזרח לוד בצד כפר טבי
10 And it is taught [in a baraita]: 'Rabbi Eliezer had fourth [year produce] of a vineyard in the east – Lod on the side of Kfar Tevi –
