Chapter 50

א והכא בטופח על מנת להטפיח איכא בינייהו:
1 but here the point at issue is that the earth must be so wet as to moisten something which can moisten something else.
ב ירד לטבול אם יכול לעלות כו': לימא תנא סתמא כר' אליעזר דאמר עד הנץ החמה
2 If he had gone down to bathe, should he have time to ascend, clothe himself and read [the Shema'] before sunrise, he must ascend, clothe himself and read. It is possible to say that the Mishnah states the law anonymously in agreement with R. Eliezer who declares: He may finish it any time until sunrise. Thou mayest even say that it is in agreement with R. Joshua and perhaps it is here like the Wetikin ;
ג אפי' תימא ר' יהושע ודלמא כותיקין דא"ר יוחנן ותיקין היו גומרין אותה עם הנץ החמה:
3 for R. Johanan said: The Wetikin finish it with the sunrise.
ד ואם לאו יתכסה במים ויקרא: והרי לבו רואה את הערוה
4 But if not, he should immerse his body in the water and read. But his heart sees his nakedness !
ה א"ר אלעזר ואי תימא ר' אחא בר אבא בר אחא משום רבינו במים עכורין שנו דדמו כארעא סמיכתא שלא יראה לבו ערותו.
5  R. Eleazar (another version : R.Aha b. Abba b. Aha in the name of our master) said : The teaching here refers to turbid water which is to be considered like the solid earth, so that his heart does not see his nakedness.
ו ת"ר מים צלולין ישב בהן עד צוארו וקורא וי"א עוכרן ברגלו
6 Our Rabbis have taught : With clear water, he must sit immersed up to his neck and read [the Shema'], while others declare he should stir up the water with his foot. But according to the first Tanna his heart sees his nakedness!
ז ות"ק והרי לבו רואה את הערוה קסבר לבו רואה את הערוה מותר והרי עקבו רואה את הערוה קסבר עקבו רואה את הערוה מותר
7 He holds that when his heart sees his nakedness, it is permitted [to read]. But lo, his heel sees his nakedness ! He holds that when his heel sees his nakedness, it is permitted.
ח אתמר עקבו רואה את הערוה מותר נוגע אביי אמר אסור ורבא אמר מותר רב זביד מתני לה להא שמעתא הכי רב חיננא בריה דרב איקא מתני לה הכי נוגע דברי הכל אסור רואה אביי אמר אסור רבא אמר מותר לא נתנה תורה למלאכי השרת והלכתא נוגע אסור רואה מותר
8 It has been reported : If his heel sees his nakedness, it is permitted [to read the Shema']. If the heel touches, Abbai says : It is forbidden [to read] ; Raba says : It is permitted. So Rab Zebid taught this subject. Rab Hinnana b. Rab Ika, however, taught it thus : If the heel touches, all agree that it is forbidden [to read] ; but if the heel sees [the nakedness], Abbai says : It is forbidden ; Raba says : It is permitted, because the Torah was not given to the ministering angels. The Halakah is : If the heel touches, it is forbidden ; if it sees, it is permitted.
ט אמר רבא צואה בעששית מותר לקרות ק"ש כנגדה ערוה בעששית אסור לקרות ק"ש כנגדה צואה בעששית מותר לקרות ק"ש כנגדה דצואה בכסוי תליא מילתא והא מיכסיא ערוה בעששית אסור לקרות ק"ש כנגדה (דברים כג, טו) ולא יראה בך ערות דבר אמר רחמנא והא קמיתחזיא
9 Raba said : If there be excrement in a transparent vessel, it is permitted to read the Shema' thereby ; if nakedness be in a transparent vessel, it is forbidden to read the Shema' thereby. "If there be excrement in a transparent vessel, it is permitted to read the Shema' thereby" ; because with excrement the criterion is whether it is covered : and behold it is covered. "If nakedness be in a transparent vessel, it is forbidden to read the Shema' thereby" ; because the All-merciful declared, "That He see no unseemly thing in thee" (Deut. xxiii. 15), and behold it is visible.
י אמר אביי צואה כל שהוא מבטלה ברוק אמר רבא וברוק עבה אמר רבא צואה בגומא מניח סנדלו עליה וקורא ק"ש בעא מר בריה דרבינא צואה דבוקה בסנדלו מאי תיקו
10 Abbai said : Should the excrement be but a minute quantity, one can nullify it [by covering it] with spittle. Raba said : It must be with thick spittle. Raba said : If excrement be in a hole, he may place his sandal over it and read the Shema'. Mar b. Rabina asked : How is it if excrement adheres to his sandal ? The question remained unanswered.
יא אמר רב יהודה עכו"ם ערום אסור לקרות ק"ש כנגדו מאי איריא עכו"ם אפילו ישראל נמי ישראל פשיטא ליה דאסור אלא עכו"ם אצטריכא ליה מהו דתימא הואיל וכתיב בהו (יחזקאל כג, כ) אשר בשר חמורים בשרם אימא כחמור בעלמא הוא קמ"ל דאינהו נמי איקרו ערוה דכתיב (בראשית ט, כג) וערות אביהם לא ראו:
11 Rab Judah said : It is forbidden to read the Shema' in the presence of a naked gentile. Why is a gentile specified ? Even by a naked Israelite it is likewise [forbidden] ! [That it is forbidden with an Israelite is obvious] ; but it was necessary to specify the case of a gentile. For thou mightest have said : Since it is written with reference to the gentiles, "Whose flesh is as the flesh of asses" (Ezek. xxiii. 20), argue that [in this matter the naked gentile is to be considered] only like an ass ; therefore he informs us that to them also [when exposed] is "nakedness" attributed ; for it is written, "And they saw not their father's nakedness" (Gen. ix. 23).
יב ולא יתכסה לא במים הרעים ולא במי המשרה עד שיטיל לתוכן מים: וכמה מיא רמי ואזיל אלא ה"ק לא יתכסה לא במים הרעים ולא במי המשרה כלל ומי רגלים עד שיטיל לתוכן מים ויקרא
12 He may not immerse himself in evil-smelling water, nor water of soaking, until he has poured [fresh] water therein. How much water must he proceed to add? Nay, the Mishnah must be read thus: He may not immerse himself at all in evil-smelling water, nor in water of soaking ; nor [may he read the Shema' by a vessel containing] urine, until he has poured [fresh] water therein, and then he may read it.
יג ת"ר כמה יטיל לתוכן מים כל שהוא ר' זכאי אומר רביעית
13  Our Rabbis have taught : How much water must be poured therein ? Any small quantity. R. Zakkai says : A fourth [of a Log].
יד אמר רב נחמן מחלוקת לבסוף אבל בתחלה כל שהן
14 Rab Nahman said : The difference of opinion applies only to [where the vessel contained urine and into which water has been poured] afterwards ; but if originally [the vessel contained water, and urine was then poured into it, then all agree] that any small quantity of water will suffice.
טו ורב יוסף אמר מחלוקת לכתחלה אבל לבסוף דברי הכל רביעית אמר ליה רב יוסף לשמעיה אייתי לי רביעיתא דמיא כר' זכאי:
15  But Rab Joseph said : The difference of opinion applies only to [where there was water] originally [and urine had afterwards been added] ; but where [water has to be added] afterwards, all agree that a fourth [of a Log] is necessary. Rab Joseph said to his attendant, "Bring me a fourth [of a Log] in accordance with the opinion of R. Zakkai."
טז ת"ר גרף של רעי ועביט של מי רגלים אסור לקרות ק"ש כנגדן ואף ע"פ שאין בהן כלום ומי רגלים עצמן עד שיטיל לתוכן מים וכמה יטיל לתוכן מים כל שהוא ר' זכאי אומר רביעית בין לפני המטה בין לאחר המטה רבן שמעון בן גמליאל אומר לאחר המטה קורא לפני המטה אינו קורא אבל מרחיק הוא ארבע אמות וקורא ר"ש בן אלעזר אומר אפי' בית מאה אמה לא יקרא עד שיוציאם או שיניחם תחת המטה
16 Our Rabbis have taught : It is forbidden to read the Shema' by a bed-pan for excrement or urine, although empty; also by urine until he has poured water therein. How much water should he pour therein ? Any small quantity. R. Zakkai says : A fourth [of a Log], whether it be before or behind the bed. Rabban Simeon b. Gamaliel says : If it be behind the bed, he may read it ; if it be before the bed he may not, but he removes himself a distance of four cubits and reads. R. Simeon b. Eleazar says : Even if the room be the size of a hundred cubits, he may not read until he has removed it or placed it under the bed.
יז איבעיא להו היכי קאמר אחר המטה קורא מיד לפני המטה מרחיק ארבע אמות וקורא או דלמא הכי קאמר לאחר המטה מרחיק ד' אמות וקורא לפני המטה אינו קורא כלל
17 The question was asked : How did [Rabban Simeon b. Gamaliel] mean, "If [the urine] be behind the bed, he may read forthwith ; if it be before the bed, he removes himself a distance of four cubits and reads" ? Or perhaps he meant this : If it be behind the bed, he removes himself a distance of four cubits and reads ; if it be in front of the bed, he may not read at all !
יח ת"ש דתניא ר"ש בן אלעזר אומר אחר המטה קורא מיד לפני המטה מרחיק ארבע אמות רבן שמעון בן גמליאל אומר אפי' בית מאה אמה לא יקרא עד שיוציאם או שיניחם תחת המטה
18 Come and hear : For there is a teaching : R. Simeon b. Eleazar says : If it be behind the bed, he may read forthwith ; if it be in front of the bed, he removes himself a distance of four cubits. Rabban Simeon b. Gamaliel says : Even if the room be the size of a hundred cubits, he may not read until he has removed it or placed it under the bed.
יט בעיין איפשיטא לן מתנייתא קשיין אהדדי איפוך בתרייתא
19 Our question is solved for us ; but the two teachings are contradictory ! Reverse [the names of the teachers] in the latter clause.
כ מה חזית דאפכת בתרייתא איפוך קמייתא
20 What seest thou to reverse [the names of the teachers] in the latter clause ? Reverse them in the former !
כא מאן שמעת ליה דאמר כוליה בית כארבע אמות דמי ר"ש בן אלעזר היא
21 Whom hast thou heard say that a whole room is to be considered as four cubits? It was R. Simeon b. Eleazar.
כב אמר רב יוסף בעאי מיניה מרב הונא מטה פחות משלשה פשיטא לי דכלבוד דמי שלשה ארבעה חמשה ששה שבעה שמנה תשעה מהו א"ל לא ידענא עשרה ודאי לא מיבעי לי אמר אביי שפיר עבדת דלא איבעיא לך כל עשרה רשותא אחריתי היא
22 Rab Joseph said : I asked Rab Huna, "If a bed is less than three [hand breadths] high, it is evident to me that it is to be regarded as solid [with the ground]; but how is it with three, four, five, six, seven, eight or nine?" He replied, "I do not know." There was certainly no need for me to ask about ten. Abbai said [to Rab Joseph], "Thou hast done well not to ask [about ten hand breadths] ; for every ten constitute a separate stratum."
כג אמר רבא הלכתא פחות משלשה כלבוד דמי עשרה רשותא אחריתי היא משלשה עד עשרה היינו דבעא מיניה רב יוסף מרב הונא ולא פשט ליה אמר רב הלכה כר"ש בן אלעזר וכן אמר באלי א"ר יעקב ברה דבת שמואל הלכה כרבי שמעון בן אלעזר ורבא אמר אין הלכה כר"ש בן אלעזר
23 Raba said : The Halakah is that less than three is regarded as solid [with the ground], and ten constitute a separate stratum ; but it is about the height from three to ten that Rab Joseph questioned Rab Huna, and he was unable to explain it. Rab said : The Halakah is in accord with R. Simeon b. Eleazar; and so declared Bali in the name of Rab Jacob, the son of Samuel's daughter : The Halakah is in accord with R. Simeon b. Eleazar. But Raba maintained the Halakah was not in accord with him.
כד רב אחאי איעסק ליה לבריה בי רב יצחק בר שמואל בר מרתא עייליה לחופה ולא הוה מסתייעא מילתא אזל בתריה לעיוני חזא ספר תורה דמנחא אמר להו איכו השתא לא אתאי סכנתון לברי דתניא בית שיש בו ספר תורה או תפילין אסור לשמש בו את המטה עד שיוציאם או שיניחם כלי בתוך כלי
24 Rab Ahai contracted a marriage between his son and the house of Rab Isaac b. Samuel b. Marta. He led him under the wedding-canopy, but the marriage was not successfully consummated. Rab Ahai went to investigate the cause, and he noticed a scroll of the Torah lying in the bedroom. He said to them, "If I had not come now, you would have endangered my son's life ; for there is a teaching : It is forbidden to have connubial intercourse in a room where a scroll of the Torah or Tefillin are lying, until they are taken out or placed in a receptacle within a receptacle."
כה אמר אביי לא שנו אלא בכלי שאינו כליין אבל בכלי שהוא כליין אפילו עשרה מאני כחד מאנא דמי אמר רבא גלימא
25 Abbai said : This teaching applies only to a receptacle which is not used expressly for that purpose ; but if it is used for that purpose, even ten receptacles are only to be considered as one. Raba said : A cloth
