Chapter 12

א ולעלמא לא חיישינן
1 In all other cases, then, do we not suspect [an exchange]?
ב והתנן
2 Have we not learnt: If a man gives to his landlady [dough to be baked], he must tithe what he gives to her and what he takes from her, because she is suspected of changing it?<span class="x" onmousemove="('comment',' Demai III, 5,');"><sup>1</sup></span>
ג הנותן לפונדקית שלו מעשר את שהוא נותן לה ואת שהוא נוטל הימנה מפני שחשודה מחלפת
3 - In this case, too, she justifies herself by saying.
ד התם נמי מוריא ואמרה
4 Let the young student rather eat the fresh and I will eat the stale.<span class="x" onmousemove="('comment',' The exchange is made with a good intent.');"><sup>2</sup></span>
ה בר בי רב ליכול חמימא ואנא איכול קרירא
5 But [otherwise], do we not suspect an exchange?
ו ולחלופי לא חיישינן
6 Surely it has been taught: The wife of a haber<span class="x" onmousemove="('comment',' V. Glos.');"><sup>3</sup></span>
ז והתניא
7 may assist the wife of an 'am ha-arez<span class="x" onmousemove="('comment',' V. Glos.');"><sup>3</sup></span>
ח אשת חבר טוחנת עם אשת עם הארץ בזמן שהיא טמאה אבל לא בזמן שהיא טהורה
8 in grinding corn only when she<span class="x" onmousemove="('comment',' Sc. the wife of the haber.');"><sup>4</sup></span>
ט רבי שמעון בן אלעזר אומר
9 is in a state of uncleanness,<span class="x" onmousemove="('comment',' Because whenever she is in a state of uncleanness she is very careful not to handle food for fear of defiling it, and she will certainly not eat of it.');"><sup>5</sup></span>
י אף בזמן שהיא טמאה לא תטחון מפני שחבירתה נותנת לה ואוכלת
10 but not when she is in a clean state.<span class="x" onmousemove="('comment',' For she may be tempted to eat of the corn, which is forbidden, being demai.');"><sup>6</sup></span>
יא השתא מיגזל גזלה חלופי מיבעיא
11 R'Simeon B'Eleazar says.
יב אמר רב יוסף התם נמי מוריא ואמרה
12 Even when she is in a state of uncleanness she may not assist in grinding, because the other would offer her some corn to eat.
יג תורא מדישיה קאכיל
13 Now, if it is said that the wife of an 'am ha-ares is ready to steal [from her husband],<span class="x" onmousemove="('comment',' And offer some to the wife of the haber.');"><sup>7</sup></span>
יד העיד רבי יהושע בן זרוז בן חמיו של רבי מאיר לפני רבי על ר"מ שאכל עלה של ירק בבית שאן והתיר רבי את בית שאן כולה על ידו
14 surely she is to be suspected of making an exchange! - In this case, too, she justifies herself by saying.
טו חברו עליו אחיו ובית אביו אמרו לו
15 The ox has a right to eat of what he threshes.
טז מקום שאבותיך ואבות אבותיך נהגו בו איסור אתה תנהוג בו היתר
16 R'Joshua B'Zeruz, the son of R'Meir's father-in-law, testified before Rabbi that R'Meir ate a leaf of a vegetable in Bethshean<span class="x" onmousemove="('comment',' Scythopolis, in Galilee. R. Meir regarded it as territory outside Palestine, and therefore its fruits and vegetables were free from tithes; for the rule relating to tithing fruits and vegetables, being a Rabbinic injunction only, applied to Palestine proper.');"><sup>8</sup></span>
יז דרש להן מקרא זה
17 [without tithing it]; on this testimony, therefore, Rabbi permitted the entire territo of Bethshean.<span class="x" onmousemove="('comment',' That the fruits and vegetables may be eaten without tithing.');"><sup>9</sup></span>
יח (מלכים ב יח, ד) וכתת נחש הנחשת אשר עשה משה כי עד הימים ההמה היו בני ישראל מקטרים לו ויקרא לו נחושתן אפשר בא אסא ולא ביערו בא יהושפט ולא ביערו
18 Thereupon his brothers and other members of his father's family combined to protest, saying: The place which was regarded as subject to tithes by your parents and ancestors will you regard as free?
יט והלא כל עבודה זרה שבעולם אסא ויהושפט ביערום
19 Rabbi, thereupon, expounded to them the following verse: And he [Hezekiah] broke in pieces the brazen serpent that Moses had made; for unto those days the children of Israel did offer to it; and it was called Nehushtan.<span class="x" onmousemove="('comment',' II Kings XVIII, 4.');"><sup>10</sup></span> Now, is it at all likely that Asa did not destroy it? Or that Jehoshaphat did not destroy it? Surely Asa and Jehoshaphat destroyed every form of idolatry in the world!
