Chapter 160

א משום רווח ביתא אבל לזבוני לא יהודה מר בר מרימר משמיה דרבא אמר מה שעשה עשוי רב פפא אמר משמי' דרבא לא עשה ולא כלום
1 in order to provide for the comfort of his home but not so that he should sell it? Judah Mar b. Meremar said in the name of Rava: Whatever he has done is done. Papa said in the name of Rava: His act has no validity.
ב אמר רב פפא הא דיהודה מר בר מרימר לאו בפירוש אתמר אלא מכללא אתמר דההיא איתתא דעיילה ליה לגברא תרתי אמהתא אזל גברא נסיב איתתא אחריתי עייל לה חדא מנייהו
2 Papa said: The statement of Judah Mar b. Meremar was not explicitly stated but was arrived at by inference. For a woman once brought to her husband two slave women, and then the man went and married another wife and assigned to her one of them.
ג אתאי לקמיה דרבא צווחה לא אשגח בה מאן דחזא סבר משום דסבר מה שעשה עשוי ולא היא משום רווח ביתא והא קא רווח
3 [When the first wife] came before Rava and cried, he paid no attention to her. One who observed [the incident] thought [that Rava’s inaction] was due to his view that whatever the husband did is valid; but in fact, it is not so. [Usufruct granted to a husband] in order to provide for the comfort of his house and here, comfort was provided.
ד והלכתא בעל שמכר קרקע לפירות לא עשה ולא כלום מ"ט אביי אמר חיישינן שמא תכסיף רבא אמר משום רווח ביתא
4 And the law is that if a husband sold [his wife’s] field for its usufruct his act has no legal validity. What is the reason? Abaye said: Lest the land deteriorate. Raba said: In order [to safeguard] the comfort of his house.
ה מאי בינייהו איכא בינייהו ארעא דמקרב למתא אי נמי בעל אריס הוא אי נמי זוזי וקא עביד בהו עיסקא:
5 What is the practical difference between them? The practical difference between them is the case of land that was adjoining a town; or else where the husband [himself] was [acting as] a sharecropper, or else where [the husband] receives money and uses it for trade.
ו <big><strong>מתני׳</strong></big> שומרת יבם שנפלו לה נכסים מודים ב"ש וב"ה שמוכרת ונותנת וקיים
6 If a woman awaiting yibbum came into possession of money: Beth Shammai and Beth Hillel agree that she may sell it or give it away, and that her act is legally valid.
ז מתה מה יעשו בכתובתה ובנכסים הנכנסין והיוצאין עמה ב"ש אומרים יחלקו יורשי הבעל עם יורשי האב וב"ה אומרי' נכסים בחזקתן וכתובה בחזקת יורשי הבעל נכסים הנכנסים והיוצאים עמה בחזקת יורשי האב
7 If she dies, what shall be done with her ketubah and with property that comes in and goes out with her? Beth Shammai says: the heirs of her husband are to share it with the heirs of her father; Beth Hillel says: he property is to remain with those in whose possession it is, the ketubah is to remain in the possession of the heirs of the husband and the property which comes in and goes out with her remains in the possession of the heirs of her father.
ח הניח אחיו מעות ילקח בהן קרקע והוא אוכל פירות פירות התלושין מן הקרקע ילקח בהן קרקע והוא אוכל פירות
8 If his brother left money, land shall be bought with it and he enjoys the usufruct. [If his brother left] produce that was detached from the ground, land shall be bought [out of the proceeds] and he enjoys the usufruct.
ט המחוברין בקרקע אמר ר"מ שמין אותן כמה הן יפין בפירות וכמה הן יפין בלא פירות והמותר ילקח בהן קרקע והוא אוכל פירות
9 [If it was] produce attached to the ground: Rabbi Meir says, the land is to be valued as to how much it is worth with the produce and how much without the produce, and with the difference land should be bought and the husband is entitled to the usufruct.
י וחכ"א פירות המחוברין בקרקע שלו התלושין מן הקרקע כל הקודם זכה בהן קדם הוא זכה קדמה היא ילקח בהן קרקע והוא אוכל פירות
10 The Sages say: produce attached to the ground belongs to the husband but that which is detached from the ground belongs to the first person who takes it: If he [seized it] first he acquires ownership; and if she [seized it] first land shall be bought with it and he enjoys the usufruct.
יא כנסה הרי היא כאשתו לכל דבר בלבד שתהא כתובתה על נכסי בעלה הראשון
11 If he married her she is his wife in every respect save that her ketubah remains a debt on her first husband’s estate.
יב לא יאמר לה הרי כתובתיך מונחת על השלחן אלא כל נכסיו אחראין לכתובתה וכן לא יאמר אדם לאשתו הרי כתובתיך מונחת על השלחן אלא כל נכסיו אחראין לכתובתה
12 He cannot say to her, “Behold your ketubah lies on the table’, rather all of his property has on it a lien from her kethubah. So too, a man may not say to his wife, behold your ketubah lies on the table, but all of his property has on it a lien from her ketubah.
יג גירשה אין לה אלא כתובה החזירה הרי היא ככל הנשים ואין לה אלא כתובה בלבד:
13 If he divorced her she is entitled only to her ketubah. If he remarried her she is like all other wives, and is entitled only to her ketubah.
יד <big><strong>גמ׳</strong></big> איבעיא להו שומרת יבם שמתה מי קוברה יורשי הבעל קברי לה דקא ירתי כתובה או דלמא יורשי האב קברי לה דקא ירתי נכסים הנכנסין והיוצאין עמה אמר רב עמרם תא שמע דתניא שומרת יבם שמתה
14 GEMARA. The question was raised: If a woman awaiting the decision of a levir died, who is responsible for burying her? Do her husband’s heirs bury her because they inherit her ketubah or do the heirs of her father bury her because they inherit the property that comes in and goes out with her? Amram said: Come and hear what was taught: If a woman awaiting the decision of a levir died,
