Chapter 19

א איתמר אמר רב נחמן אמר שמואל משום רבי שמעון בן אלעזר חכמים תקנו להם לבנות ישראל לבתולה מאתים ולאלמנה מנה והם האמינוהו שאם אמר פתח פתוח מצאתי נאמן א"כ מה הועילו חכמים בתקנתם
1 It was stated: Rav Nahman said in the name of Shmuel who said in the name of R. Shimon ben Elazar: The rabbis enacted for the daughters of Israel, for a virgin two hundred zuz and for a widow a maneh [one hundred zuz]. And they believed him, so that if he said, “I have found an open opening,” he is believed. If so, what have the Sages accomplished with their enactment?
ב אמר רבא חזקה אין אדם טורח בסעודה ומפסידה
2 Rava said: The presumption is [that] no one will take the trouble of preparing a wedding feast and will then spoil it.
ג תנא הואיל וקנס חכמים הוא לא תגבה אלא מן הזיבורית קנסא מאי קנסא אלא אימא הואיל ותקנת חכמים הוא לא תגבה אלא מן הזיבורית רבן שמעון בן גמליאל אומר כתובת אשה מן התורה
3 It was taught: Since it is a fine instituted by the sages she collects only from the worst land [of the husband’s estate]. A fine! Why is it a fine? Rather say: Since it is an enactment of the sages, she collects only from the worst land [of the husband’s estate]. Rabban Shimon ben Gamaliel says: A woman’s ketubah is from the Torah.
ד ומי אמר רבן שמעון בן גמליאל הכי והתניא (שמות כב, טז) כסף ישקול כמוהר הבתולות שיהא זה כמוהר הבתולות ומוהר הבתולות כזה מכאן סמכו חכמים לכתובת אשה מן התורה רבן שמעון בן גמליאל אומר כתובת אשה אינה מדברי תורה אלא מדברי סופרים
4 But did Rabban Shimon ben Gamaliel really say this? But it has been taught: [It is written in the Torah] “He shall pay money according to the bride-price of virgins” (Exodus 22:16); that this is as much as the dowry of the virgins and the dowry of the virgins is as much as this. From here the Sages found a support for [the rule that] a woman’s ketubah is from the Torah. Rabban Shimon b. Gamaliel says: A woman’s ketubah is not from the words of the Torah, but from the words of the scribes.
ה איפוך ומאי חזית דאפכת בתרייתא איפוך קמייתא
5 Reverse it. And what did you see to reverse the latter? Reverse the former!
ו הא שמעינא ליה לרבן שמעון בן גמליאל דאמר כתובת אשה מדאורייתא דתנן רבן שמעון בן גמליאל אומר נותן לה ממעות קפוטקיא
6 We have heard that R. Shimon ben Gamaliel said that the ketubah is from the Torah, for we learned: Rabban Shimon b. Gamaliel says: He gives her [the ketubah] in Cappadocian coins.
ז ואי בעית אימא כולה רבן שמעון בן גמליאל היא וחסורי מיחסרא והכי קתני מכאן סמכו חכמים לכתובת אשה מן התורה כתובת אלמנה אינה מדברי תורה אלא מדברי סופרים שרבן שמעון בן גמליאל אומר כתובת אלמנה אינה מדברי תורה אלא מדברי סופרים
7 And if you wish, you may say: The whole of it follows Rabban Shimon b. Gamaliel and it is defective and it teaches thus: From here the sages found a support from the Torah for a woman’s ketubah. The ketubah of a widow is not from the Torah but from the words of the scribes, for Rabban Shimon b. Gamaliel says: The ketubah of a widow is not from the words of the Torah but from the words of the scribes.
ח ההוא דאתא לקמיה דרב נחמן אמר ליה פתח פתוח מצאתי אמר ליה רב נחמן אסבוהו כופרי מברכתא חביטא ליה
8 A certain man came before R. Nahman and said to him: I have found an open opening. Nahman answered: Lash him with palm branches; prostitutes were available to him.
ט והא רב נחמן הוא דאמר מהימן מהימן ומסבינן ליה כופרי רב אחאי משני כאן בבחור כאן בנשוי
9 But it is R. Nahman who said that he [the husband] is believed! He is believed, but they also lash him with palm-branches. Ahai answered: Here [it refers] to a young man, there [it refers] to one was married before.
י ההוא דאתא לקמיה דרבן גמליאל אמר ליה פתח פתוח מצאתי אמר ליה שמא הטיתה אמשול לך משל למה הדבר דומה לאדם שהיה מהלך באישון לילה ואפילה היטה מצאו פתוח לא היטה מצאו נעול
10 A certain came before Rabban Gamaliel [and] said to him, I have found an “open opening”. He [Rabban Gamaliel] answered him: Perhaps you moved aside. I will give you a parable: To what is this like? To a man who was walking in the deep darkness of the night [and came to his house and found the door locked]. If he moves aside [the bolt of the door] he finds it open, if he does not move aside [the bolt of the door] he finds it locked.
יא איכא דאמרי הכי אמר ליה שמא במזיד הטיתה ועקרת לדשא ועברא אמשול לך משל למה הדבר דומה לאדם שהוא מהלך באישון לילה ואפילה היטה במזיד מצאו פתוח לא היטה במזיד מצאו נעול
11 There are those who say [that] he [R. Gamaliel] answered him thus: Perhaps you moved aside intentionally and you tore away the door and the bar. I will give you a parable: To what is this like? To a man who was walking in the deep darkness of the night [and came to his house and found the door locked]; if he moves aside [the bolt of the door] intentionally he finds it open, if he does not move aside [the bolt of the door] intentionally he finds it locked.
יב ההוא דאתא לקמיה דרבן גמליאל בר רבי אמר ליה רבי בעלתי ולא מצאתי דם אמרה לו רבי בתולה הייתי אמר להם הביאו לי אותו סודר הביאו לו הסודר ושראו במים וכבסו ומצא עליו כמה טיפי דמים אמר לו לך זכה במקחך
12 A certain man came before Rabban Gamaliel the son of Rabbi [and] said to him: My master, I have had intercourse and I have not found any blood. She said to him: My master, I was a virgin. He said to them: Bring me that cloth. They brought him the cloth, and he soaked it in water and he washed it and he found on it a some drops of blood. He [Rabban Gamaliel] said to him [the husband]: Go, be happy with your acquisition.
יג אמר ליה הונא מר בריה דרבא מפרזקיא לרב אשי אנן נמי נעביד הכי אמר ליה
13 Huna Mar the son of Rava of Parazikia said to R. Ashi: We should also do this? He answered him:
