Chapter 11

א אמר רבי יוסי במה דברים אמורים בדיני נפשות אבל בדיני ממונות תתקיים העדות בשאר רבי אומר אחד דיני ממונות ואחד דיני נפשות
1 Rebbi Yosi says, In what are these words [that one disqualified witness can disqualify three] said? Only by capital cases, but by monetary cases the testimony can be maintained with the remaining [two witnesses]. Rebbi says, This [ruling] applies by both monetary cases and capital cases.
ב ואימתי בזמן שהתרו בהן אבל בזמן שלא התרו בהן מה יעשו שני אחין שראו באחד שהרג את הנפש:
2 But when [does it apply]? Only when they [the witnesses in question] had warned the perpetrator. But [if it would] apply in a time when they [the witnesses in question] had not warned the perpetrator, then what would two brothers who together witnesses a murder be able to do?
ג <big><strong>גמ׳</strong></big> אמר רבא והוא שהעידו כולם בתוך כדי דיבור אמר ליה רב אחא מדפתי לרבינא מכדי תוך כדי דיבור היכי דמי כדי שאילת תלמיד לרב מאה טובא הוו
3 GEMARA:Rava says, and this [that one can disqualify the whole group of witnesses] is only when they all testified בתוך כדי דיבור. Rav Acha mDifti said to Revina, let's see, how long is בתוך כדי דיבור? The amount of time that it takes for a student to greet his teacher. A hundred [witnesses] is too many [to all give testimony in this time slot]?!
ד אמר ליה כל חד וחד בתוך כדי דיבור של חבירו:
4 He answered him, Each and every one of them testifies בתוך כדי דיבור of the previous witness.
ה רבי עקיבא אומר לא בא שלישי כו' ומה שנים כו': אמר ליה רב פפא לאביי אלא מעתה הרוג יציל כשהרגו מאחוריו
5 Rebbi Akiva says the third on didn't come etc. and just as by two [one could disqualify the group] etc. Rav said to Rav Papa But now, let the victim [who is a witness to his own murder] save [the murderer from being executed]? [The case] is where he was killed from behind.
ו נרבע יציל כשרבעו מאחוריו
6 Let the sodomized man save the sodomizer? Where he was sodomized from behind.
ז הורג ורובע יצילו אישתיק כי אתא לקמיה דרבא אמר ליה (דברים יט, טו) יקום דבר במקיימי דבר הכתוב מדבר:
7 Let the murderer and the sodomizer save them selves? He was silent. When he came before Rava, [Rava] told him, (Deuteronomy 19, 15) "The matter should be established" implies that the Torah is exclusively referring to those who establish the matter.
ח אמר רבי יוסי במה דברים אמורים וכו' מה יעשו שני אחים כו': היכי אמרינן להו
8 Rebbi Yosi says, in what were these words said? etc. what should two brothers do? etc.: What do we say to the witnesses?
ט אמר רבא הכי אמרי' להו למיחזי אתיתו או לאסהודי אתיתו אי אמרי לאסהודי אתו נמצא אחד מהן קרוב או פסול עדותן בטלה אי אמרי למיחזי אתו מה יעשו שני אחין שראו באחד שהרג את הנפש:
9 Rava answered, this is what we say to them, Did you come to see or did you come to testify? If they respond that they came to testify, then if one of them is found to be a relative or a disqualified [witness], the whole [group of] testimony is dismissed. But if they respond that they came to see, [then they can't disqualify the whole group because otherwise] what should two brothers do who together witnessed a murder?
י איתמר אמר רב יהודה אמר שמואל הלכה כר' יוסי ורב נחמן אומר הלכה כרבי:
10 It has been said, Rav Yehuda says in the name of Shmuel, The law follows Rebbi Yosi. And Rav Nachman says, The law follows Rebbi.
