Chapter 29

א <big><strong>מתני׳</strong></big> תקרה שאין עליה מעזיבה ר' יהודה אומר בית שמאי אומרים מפקפק ונוטל אחת מבינתים ובית הלל אומרים מפקפק או נוטל אחת מבינתים רבי מאיר אומר נוטל אחת מבינתים ואינו מפקפק:
1 Mishnah: A [wooden] roof that has no plastering: Rabbi Judah says: Bet Shammai say that he should loosen [the planks] and remove one from between each two. And Bet Hillel say he should either loosen [the planks] or remove one from between two. Rabbi Meir says, he removes one from between two, but he does not loosen [the planks].
ב <big><strong>גמ׳</strong></big> בשלמא ב"ה טעמייהו משום תעשה ולא מן העשוי אי מפקפק עביד ליה מעשה אי נוטל אחת מבינתים עבד בה מעשה אלא בית שמאי מאי טעמייהו אי משום תעשה ולא מן העשוי בחדא סגי אי משום גזרת תקרה בנוטל אחת מבינתים סגי
2 GEMARA. It is well according to Bet Hillel; their reason is that ‘You shall make’, but not from that which is [already] made. If he loosens [the planks] he performs an action, and if he removes one from between two he performs an action. But what is the reason of Beth Shammai? If it is ‘You shall make’ but not from that which is [already] made, one act only should be sufficient; if it is because of a decree lest one use ordinary roofing, it should suffice if he removes one from between two?
ג לעולם משום גזרת תקרה והכי קאמרי אף על פי שמפקפק אי נוטל אחת מבינתים אין אי לא לא
3 Indeed it is because of a decree lest one use ordinary roofing, and this is what they say: Even although he loosens them, if he removes one from between two, it is [valid], otherwise it is not.
ד אי הכי אימא סיפא ר' מאיר אומר נוטל אחת מבינתים אבל לא יפקפק רבי מאיר היינו בית שמאי
4 If so, read the concluding [part:] R. Meir ruled, he should remove one from between two, but not loosen. Is not R. Meir's view thus identical with that of Beth Shammai?
ה הכי קאמר לא נחלקו ב"ש וב"ה בדבר זה
5 This is what he (R. Meir) means: Bet Shammai and Beth Hillel did not dispute on this point.
ו מאי קמ"ל דר"מ אית ליה גזרת תקרה ור"י לית ליה גזרת תקרה והא אפליגו בה חדא זימנא דתנן מסככין בנסרים דברי ר' יהודה ורבי מאיר אוסר
6 What [then] does [the Mishnah] teach us? That R. Meir holds that there is decree lest the sukkah look like ordinary roofing, while R. Judah holds that there is no such decree? But have they not already disputed this, as we have learned: Planks may be used for skhakh, the words of R. Judah; R. Meir forbids them.
ז א"ר חייא בר אבא א"ר יוחנן רישא בנסרים משופין עסקינן ומשום גזרת כלים נגעו בה
7 R. Hiyya b. Abba answered in the name of R. Yohanan, The former mishnah deals with planed boards and they forbade them as a decree lest he comes to use vessels
ח ולר"י אמר רב דאמר סככה בחיצין זכרים כשרה בנקבות פסולה ולא גזר זכרים אטו נקבות הכא נמי לא נגזר נסרים משופין אטו כלים
8 But according to Rav Judah who said in the name of Rav: ‘If he covered the sukkah with plain arrowshafts, it is valid; with bored arrow-shafts, it is invalid’, and he does not decree against plain shafts on account of [the possible use of] bored ones; here also we should not restrict planed boards on account of [the possible use of] vessels?
ט אלא על כרחך רישא פליגי בגזרת תקרה וסיפא פליגי בגזרת תקרה ואפליגי בתרתי זימני ל"ל
9 Rather to say that the dispute in the former [mishnah] is on the question whether a we decree against something [that might lead to] the possible use of an ordinary roofing and that the dispute in the latter mishnah is also on the same question; but why should they dispute the same question twice?
י סיפא ר' יהודה (היא) דקא אמר ליה לרבי מאיר אמאי קא אסרת בנסרים משום גזרת תקרה האי סברא לבית שמאי הוא דאית להו ובית הלל לא גזרי אמר רבי מאיר לא נחלקו ב"ש וב"ה בדבר זה
10 The latter [mishnah] is what R. Judah said to R. Meir: ‘Why do you forbid planks? As a decree against [the possible use of] an ordinary roofing? But it is Beth Shammai only who hold this opinion while Beth Hillel do not decree [against planks]. To this R. Meir said that Bet Shammai and Bet Hillel do not dispute this point at all.
יא הניחא לרב דאמר מחלוקת בשיש בהן ארבעה דר' מאיר אית ליה גזרת תקרה ורבי יהודה לית ליה גזרת תקרה אלא לשמואל דאמר בשאין בהן ארבעה מחלוקת אבל יש בהן ארבעה דברי הכל פסולה סיפא במאי פליגי
11 This is correct according to Rav who says that the dispute is where the planks are four [handbreadths wide], since in such a case R. Meir holds that we decree lest one come to use ordinary roofing while R. Judah says we don't decree lest one use ordinary roofing But according to Shmuel, who says that the dispute is where the planks are not four [handbreadths wide], but that where they are four handbreadths wide all agree that it is invalid, on what principle do they dispute in the latter [Mishnah]?
יב בביטולי תקרה קא מיפלגי מר סבר בטלה בהכי ומר סבר בהכי לא בטלה:
12 They dispute on [the question of] the annulment of a roof. One master holds the opinion that by this means it becomes annulled, while the other master holds the opinion that by this means it does not become annulled.
יג <big><strong>מתני׳</strong></big> המקרה סוכתו בשפודין או בארוכות המטה אם יש ריוח ביניהן כמותן כשרה החוטט בגדיש לעשות לו סוכה אינה סוכה:
13 Mishnah One who roofs his sukkah with iron spits or with bedposts, if the space between them equals them, it is valid. One who hollows out a haystack to make for himself a sukkah, it is not a valid sukkah.
יד <big><strong>גמ׳</strong></big> לימא תיהוי תיובת' דרב הונא בריה דרב יהושע דאתמר פרוץ כעומד רב פפא אמר מותר ורב הונא בריה דרב יהושע אמר אסור
14 Gemara: Can we say that this is a refutation of R. Huna, the son of R. Joshua, since it was stated: If the breach is equal to that which is standing, R. Papa says it is permitted, and R. Huna the son of R. Joshua says it is forbidden?
טו אמר לך רב הונא בריה דרב יהושע מאי כמותן בנכנס ויוצא
15 R. Huna the son of R. Joshua can answer, ‘What is meant by equals them? That it can easily pass through them.
