Chapter 6

א ואין עושין אותו עיבור בין שתי עיירות ואין האחין והשותפין חולקין בו
1 nor make of it an extension between two cities, nor can brothers or partners divide it?
ב לימא רבי היא ולא רבנן אפילו תימא רבנן עד כאן לא קאמרי רבנן התם אלא לענין סוכה דדירת עראי היא אבל לגבי בית דדירת קבע הוא אפי' רבנן מודו דאי אית ביה ד' אמות על ד' אמות דיירי ביה אינשי ואי לא לא דיירי ביה אינשי:
2 Must we say that it agrees with Rabi, and not with the Rabbis? No! One can even say that it agrees with the Rabbis. The Rabbis say it only with regard to a Sukkah which is a temporary dwelling, but with regard to a house which is a permanent dwelling, even the Rabbis admit that if it has an area of four <i>amos</i>, people live in it, otherwise, they do not dwell within.
ג אמר מר פטור מן המזוזה ומן המעקה ואין מטמא בנגעים ואינו נחלט בבתי ערי חומה ואין חוזרין עליו מעורכי המלחמה מ"ט דבית כתיב בהו בכולהו
3 Master says: ‘It is free from the obligations of Mezuzah, and parapet, does not become <i>tamay</i> from leprosy, is not irredeemable among the houses of a walled city, nor does one return on account [of it just being built] from the war’ What is the reason? Because the term ‘house’ occurs in all [these commandments].
ד ואין מערבין בו ואין משתתפין בו ואין מניחין בו עירוב מ"ט דלא חזי לדירה עירובי חצירות אין מניחין בו אבל שיתוף מניחין בו
4 ‘Nor does an <i>Eruv</i> be prepared for it, nor Shittuf, nor does one place within an <i>Eruv</i>’. What is the reason? Because it is unsuitable as a dwelling. Now the <i>Eruv</i> of courtyards is not placed within, but a Shittuf may be placed within.
ה מ"ט דלא גרע מחצר שבמבוי דתנן עירובי חצירות בחצר שיתופי מבוי במבוי
5 What is the reason? Since it is no worse than a courtyard within an alleyway, The <i>Tana</i> says: ‘The <i>Eruv</i> of courtyards [are placed] in a courtyard, and the shittuf of an alley in the alley’.
ו והוינן בה עירובי חצירות בחצר והתנן הנותן עירובו בבית שער אכסדרה ומרפסת אינו עירוב והדר שם אינו אוסר
6 And the point was raised, [How can it be said that], The <i>Eruv</i> of courtyards [are placed] in a courtyard? And the <i>Tana</i> says: If a man placed his <i>Eruv</i> in a gatehouse or in an exedra (a semicircular recess), or in a ballcony, it is <i>asur</i> and he who dwells within it cannot be a cause of prohibition?
ז אלא אימא עירובי חצירות בבית שבחצר ושיתופי מבואות בחצר שבמבוי והאי לא גרע מחצר שבמבוי
7 We should say rather, <i>Eruv</i>'s of courtyards [are placed] in a house of the courtyard, and the Shittufs of alleys in a courtyard of the alley; and this is no worse than a courtyard in an alley.
ח ואין עושין אותו עיבור בין שתי עיירות דאפי' כבורגנין לא משוינן ליה מ"ט בורגנין חזו למילתייהו והאי לא חזי למילתיה
8 <b>(Now going back to the Barissa)</b>‘Nor make of it an extension between two cities’. Since it is not regarded even as an outpost. What is the reason? Outposts are suitable for their purpose, but this [the four <i>amah</i> house] is unsuitable for anything.
ט ואין האחין והשותפין חולקין בו טעמא דלית ביה ד' אמות הא אית ביה ד' אמות חולקין
9 ‘Nor can brothers or partners divide it’. Because it is not four <i>amos</i> by four <i>amos</i>, but if it were larger than four <i>amos</i>, [presumably] they could divide it.
י והתנן אין חולקין את החצר עד שיהא בה ארבע אמות לזה וארבע אמות לזה
10 But have we not learnt, A courtyard should not be divided unless there is four <i>amos</i> to each [of the parties]?
יא אלא אימא אין בו דין חלוקה כחצר דאמר רב הונא חצר לפי פתחיה מתחלקת ורב חסדא אמר נותן לכל פתח ופתח ארבע אמות והשאר חולקין אותו בשוה
11 Say rather, The law of division does not apply to it, as [it does in the case of] a courtyard. For R' Huna ruled, ‘A courtyard is divided according to the number of its doors.’ (and) R' Chisda said, ‘Four <i>amos</i> are given for each door and the remainder is divided equally’.
יב דהני מילי בית דלמהוי קאי יהבינא ליה חצר האי דלמיסתר קאי לא יהבינן ליה חצר:
12 This applies only to a house which is intended to stand, [and therefore] we allow it a [share in the] courtyard; but as to this [a hovel] which is intended to be demolished, we do not allow it [a share in the] courtyard.
יג היתה גבוהה מעשרים אמה ובא למעטה בכרים וכסתות לא הוי מיעוט
13 [A sukkah where the shach] was taller than 20 amah, and [someone] came to lower it by putting pillows and blankets on the floor: It is not considered to have been lowered.
