Chapter 80

א מרבה אני את הכבוסה ששוה בכל אדם ומוציא את המלוגמא שאינה שוה לכל אדם
1 I include washing since it is a requirement common to all men and exclude a salve since it is not common to all men.
ב מאן תנא להא דת"ר לאכלה ולא למלוגמא לאכלה ולא לזילוף לאכלה ולא לעשות ממנה אפיקטויזין כמאן כר' יוסי דאי רבנן הא איכא נמי משרה וכבוסה
2 Who is the author of that [statement] which our Rabbis taught: “for food” but not for a salve, “for food”, but not for perfume, “for food” but not for an emetic. Who does this agree with? With R. Yose, for if it were the Rabbis, they also exclude steeping and washing.
ג אמר ר' אלעזר אין שביעית מתחללת אלא דרך מקח ורבי יוחנן אמר בין דרך מקח בין דרך חילול
3 R. Elazar said: Sabbatical year produce is redeemed only by way of sale. But R. Yohanan said: Either by way of sale or by way of exchange. What is the reason of R. Elazar? As it is written, "In this year of Jubilee" (Leviticus 25:13) and then comes the following verse, "And if you sell something to your neighbor" [implying,] only by way of sale, but not by way of exchange.
ד מ"ט דר' אלעזר דכתיב (ויקרא כה, יג) בשנת היובל הזאת וגו' וסמיך ליה וכי תמכרו ממכר דרך מקח ולא דרך חילול ורבי יוחנן מ"ט דכתיב כי יובל היא קדש מה קדש בין דרך מקח בין דרך חילול אף שביעית בין דרך מקח בין דרך חילול
4 And what is the reason of R. Yohanan? — Since it is written, "For it is a Jubilee, it shall be holy" (Leviticus 25:12); just as sacred objects can be redeemed either by way of sale or by way of exchange, so the produce of the Sabbatical Year can be redeemed either by way of sale or by way of exchange.
ה ורבי יוחנן האי כי תמכרו ממכר מאי עביד ליה מיבעי ליה לכדר' יוסי בר חנינא דתניא א"ר יוסי בר חנינא בוא וראה כמה קשה אבקה של שביעית וכו' אדם נושא ונותן בפירות שביעית לסוף מוכר את מטלטליו ואת כליו שנאמר בשנת היובל הזאת תשובו איש אל אחוזתו וסמיך ליה וכי תמכרו ממכר לעמיתך וגו'
5 But what does R. Yohanan do with the verse, "And if you sell something to your neighbor"? He requires it in accordance with the statement of R. Yose b. Hanina, as it has been taught, R. Yose b. Hanina said: Come and see how serious is [even] the dust of the Sabbatical Year. A man merely trades with the produce of the Sabbatical Year, in the end he sells his movable property and his clothes, as it is said, "In this year of Jubilee you shall return, each man to his possessions" and then comes immediately, "And if you sell something to your neighbor etc."
ו ור' אלעזר האי קרא דר' יוחנן מאי עביד ליה מיבעי ליה לכדתניא (ויקרא כה, יב) כי יובל היא קדש מה קדש תופס את דמיו אף שביעית תופסת את דמיה
6 And R. Eleazar, what does he do with the verse of R. Yohanan? He needs it in accordance with what has been taught, "For it is a Jubilee, it shall be holy" (Leviticus 25:12) just as with holy objects the money [for which it is redeemed] assumes the same sanctity, so with the produce of the Sabbatical Year, the money [for which it is sold] assumes the same sanctity.
ז תניא כוותיה דר' אלעזר ותניא כוותיה דרבי יוחנן תניא כוותיה דרבי אלעזר שביעית תופסת את דמיה שנאמר כי יובל היא קדש תהיה לכם מה קדש תופס את דמיו ואסור אף שביעית תופסת את דמיה ואסורה
7 It has been taught in agreement with R. Elazar, and it has also been taught in agreement with R. Yohanan. It has been taught in agreement with R. Elazar: [In the case of produce of] the Sabbatical Year the money [for which it is exchanged] assumes the same sanctity [as the produce itself], for it is said, "For it is a Jubilee, it shall be holy to you" just as with holy objects the money [for which it is redeemed assumes] the sanctity [of the holy object], and becomes forbidden, so with the produce of the Sabbatical Year, the money [for which it is redeemed] assumes the same sanctity [as the produce] and becomes forbidden.
ח אי מה קדש תופס דמיו ויוצא לחולין אף שביעית תופסת את דמיה ויוצאת לחולין תלמוד לומר תהיה בהוייתה תהא
8 [But] in case [you would say] that just as, with holy objects, the money [for which it is redeemed] assumes its sanctity and [the holy object itself] becomes desacralized, so also with the produce of the Sabbatical Year, the money for which it is redeemed assumes its sanctity and the [produce itself] becomes desacralized, Scripture explicitly says, "It shall be"—it remains in its original [holy] state.
ט הא כיצד לקח בפירות שביעית בשר אלו ואלו מתבערין בשביעית לקח בבשר דגים יצא בשר ונכנסו דגים לקח בדגים יין יצאו דגים ונכנס יין לקח ביין שמן יצא יין ונכנס שמן
9 How so? If with the produce of the Sabbatical Year he purchased meat, both the meat and the produce must be removed during the Sabbatical Year. If, however, he purchased with the meat fish, the meat loses [the sanctity of the produce of the Sabbatical Year], and the fish assumes it. If he purchased with the fish wine, the fish loses [its sanctity], and the wine assumes it. If he purchased with the wine oil, the wine loses [its sanctity] and the oil assumes it.
י הא כיצד אחרון אחרון נכנס בשביעית ופרי עצמו אסור מדקתני לקח לקח אלמא דרך מקח אין דרך חילול לא
10 How so? The last object [purchased] assumes [the sanctity] of the Sabbatical Year, but the produce itself always remains prohibited. Now since the term "purchased" is repeatedly used, it is evident that only by way of sale [does it become redeemed], but not by way of exchange.
יא תניא כוותיה דר' יוחנן אחד שביעית ואחד מעשר שני מתחללין על בהמה חיה ועוף בין חיין בין שחוטין דברי ר' מאיר וחכמים אומרים על שחוטין מתחללין על חיין אין מתחללין גזירה שמא יגדל מהן עדרים
11 It was taught in agreement with R. Yohanan: Both the produce of the Sabbatical Year and of Second Tithe may be redeemed with cattle, beast or fowl, whether live or slaughtered, the words of R. Meir. But the sages say: With slaughtered [animals and birds] they may be redeemed, but not with live ones, lest one rear flocks from them.
