Chapter 81

א בזכרים אבל בנקבות דברי הכל על שחוטין מתחללין על חיין אין מתחללין גזרה שמא יגדל מהן עדרים
1 applies only to male [animals and birds], but with regard to female ones, all agree that they may be redeemed with slaughtered animals, but not with live ones, lest one rear flocks with them.
ב אמר רב אשי מחלוקת בפרי ראשון אבל בפרי שני דברי הכל בין דרך מקח בין דרך חילול והא דקתני לקח לקח איידי דתנא רישא לקח תנא נמי סיפא לקח
2 R. Ashi said: The dispute concerns only the original produce itself, but with regard to secondary produce, both agree that [it can be redeemed] either by way of sale or by way of exchange. And the reason that the term ‘purchased’ was repeated is that since in the first clause the term ‘purchased’ was used it was used in the latter clause also.
ג איתיביה רבינא לרב אשי מי שיש לו סלע של שביעית וביקש ליקח בו חלוק כיצד יעשה ילך אצל חנווני הרגיל אצלו ואומר לו תן לי בסלע פירות ונותן לו וחוזר ואומר לו הרי פירות הללו נתונים לך במתנה והוא אומר לו הא לך סלע זו במתנה והלה לוקח בהן מה שירצה והא הכא דפרי שני הוא וקתני דרך מקח אין דרך חילול לא
3 Ravina raised an objection against R. Ashi: [It has been taught]: If a man has a sela [gained through selling the produce of] the Sabbatical Year, and wishes to purchase with it a shirt, what should he do? Let him go to his regular shopkeeper and say to him, ‘Give me a sela worth of fruit’ and give it to him. Then he tells him, ‘Behold this fruit is given [back]] to you as a gift’, and [the shopkeeper] answers him, ‘And here is a gift for you of a sela.' And then he may purchase with it whatsoever he desires. Now here, surely, the sela is a secondary produce, and yet it teaches [that it may be redeemed only] by way of sale, and not by way of exchange?

4 Rather R. Ashi said: The dispute [of R. Elazar and R. Yohanan] is over secondary produce, but with regard to the original produce all agree that [it may be redeemed] only by way of sale, and not by way of exchange. "Both the produce of the Sabbatical Year and of the Second Tithe [may be redeemed by exchange]"— his refers to the money for which the produce is exchanged.
ה דאי לא תימא הכי מעשר מעשר ממש והא כתיב (דברים יד, כה) וצרת הכסף בידך אלא דמי מעשר הכא נמי דמי שביעית:
5 For if you do not say so, then "tithe" also must mean actual tithe. But surely it is written, "You shall bind the money in your hand? (Deuteronomy 14:21). Rather it must mean the money for which tithe [was exchanged], and so here also it means the money for which the produce of the Sabbatical Year [is exchanged].
ו <big><strong>מתני׳</strong></big> בראשונה היה לולב ניטל במקדש שבעה ובמדינה יום אחד משחרב בית המקדש התקין רבן יוחנן בן זכאי שיהא לולב ניטל במדינה שבעה זכר למקדש
6 In earlier times the lulav was taken for seven days in the Temple, and in the provinces for one day only. When the temple was destroyed, Rabbi Yohanan ben Zakkai decreed that the lulav should be taken in the provinces for even days in memory of the Temple,
ז ושיהא יום הנף כולו אסור:
7 [He also decreed] that on the whole of the day of waving it be forbidden [to eat the new produce].
ח <big><strong>גמ׳</strong></big> מנא לן דעבדינן זכר למקדש א"ר יוחנן דאמר קרא (ירמיהו ל, יז) כי אעלה ארוכה לך וממכותיך ארפאך נאם ה' כי נדחה קראו לך ציון היא דורש אין לה דורש אין לה מכלל דבעיא דרישה:
8 From where do we know that we must perform [ceremonies] in memory of the Temple? R. Yohanan said: Since Scripture says, "For I will restore health to you, and I will heal you of your wounds, says the Lord, Because they have called you an outcast. She is Zion, there is none that seek for her" (Jeremiah 30:17). ‘There is none that see for her,' implies that she should be sought.
ט ושיהא יום הנף: מ"ט מהרה יבנה בית המקדש ויאמרו אשתקד מי לא אכלנו בהאיר מזרח השתא נמי ניכול ואינהו לא ידעי דאשתקד דלא הוה בית המקדש האיר מזרח התיר השתא דאיכא בית המקדש עומר מתיר
9 And that the whole day of waving should be prohibited. What is the reason? The Temple may be rebuilt speedily, and people would say, "Did we not eat [new grain] last year from the time that light appeared in the east? Let us now also eat it [from the same time]" and they would not know that in the previous year, when there was no Temple, once day dawned in the east it,was permitted [to eat of the new grain], but now that the Temple is rebuilt, it is only the [waving of the] omer which [begins] the permission to eat new grain.
י דאיבני אימת אילימא דאיבני בשיתסר הרי התיר האיר מזרח אלא דאיבני בחמיסר מחצות היום ולהלן תשתרי דהא תנן הרחוקים מותרין מחצות היום ולהלן לפי שאין ב"ד מתעצלים בו
10 But when [is this assume the Temple to be] rebuilt? If you will say that it is rebuilt on the sixteenth [of Nissan], then obviously it is permitted to eat from the time that day dawned in the East? If, however, it is rebuilt on the fifteenth why should it not be permitted after midday, for we have learned, Those that lived at a distance were permitted [to eat of the new grain] from midday onward, because [they knew that] the court would not be negligent in the matter?
יא לא צריכא דאיבני בליליא אי נמי סמוך לשקיעת החמה (אמר) רב נחמן בר יצחק אמר רבן יוחנן בן זכאי בשיטת ר' יהודה אמר' דאמר מן התורה הוא אסור דכתיב
11 This was necessary [only in case] it is rebuilt at night, or [on the fifteenth] close to sunset. R. Nahman b. Yitzchak said: R. Yohanan b. Zakkai instituted this in accordance with a principle of R. Judah who holds that from the Torah the whole day is forbidden, since it is written,
