ולימא הלכה כרבי יוחנן בן נורי להעדפה אי נמי אין הלכה כתנא קמא אי נמי הלכה כרבי עקיבא

Then let him specifically state: The halakhah is in agreement with R. Yohanan b. Nuri in respect of the surplus” or else “The halakhah is not in agreement with the first Tanna” or else, “The halakhah is in agreement with R. Akiva.”
