והשתא דאמרת בעלת חוב הויא דאבא או דאחי למאי נפקא מינה למיגבא לבינונית שלא בשבועה וזיבורית בשבועה

Now that it has been said this, is she a creditor of the father or of the brothers? What does this matter? In respect [of allowing her] to collect [her tenth] either from their medium land and without an oath, or of their worst land with an oath.
