Commentary for Ketubot 176:5

וקמיפלגי בפלוגתא דאבא שאול ורבנן דתנן אפוטרופוס שמינהו אבי יתומים ישבע מינוהו בית דין לא ישבע אבא שאול אומר חילוף הדברים מינוהו בית דין ישבע מינהו אבי יתומים לא ישבע

And they differ on the same principles as those on which Abba Shaul and the rabbis differed; for we have learned: A guardian who was appointed by the father of the orphans is required to take an oath. [A guardian who was] appointed by the court does not need to take an oath. Abba Shaul says that the rule is the reverse.
