לא ס"ד דכתיב (ויקרא כד, כא) ומכה בהמה ישלמנה ומכה אדם יומת היכי דמי אי דלא אתרו ביה מכה אדם אמאי יומת אלא פשיטא דאתרו ביה ואי בשבת מכה בהמה ישלמנה אלא לאו בחול
This cannot be, for it is written: “And he that kills a beast shall pay for it, and he that kills a man shall be put to death.” What is this case? If they did not warn him, why should one who killed a man be put to death? Rather it is clear that they warned him, and if [it happened] on Shabbat would he, if he killed a beast, pay for it? Therefore it can only refer to a week-day.
