Halakhah for Sanhedrin 79:7

אחד אומר בשתי שעות ואחד אומר בשלש שעות עדותן קיימת אחד אומר בשלש ואחד אומר בחמש עדותן בטילה

IF ONE [WITNESS] TESTIFIES, '[IT HAPPENED] ON THE SECOND OF THE MONTH,' AND THE OTHER, 'ON THE THIRD OF THE MONTH:' THEIR EVIDENCE IS VALID, FOR ONE MAY HAVE BEEN AWARE OF THE INTERCALATION OF THE MONTH AND THE OTHER MAY NOT HAVE BEEN AWARE OF IT.<span class="x" onmousemove="('comment',' I.e., one knew that the previous month had consisted of thirty days whilst the other thought that it had consisted only of twenty-nine days provided they agree as to the day of the week. Cf. Kesef Mishneh, on Yad'Eduth II, 4, and Tosaf. 41b s.v. [H]. ');"><sup>12</sup></span> IF, HOWEVER, ONE SAYS, 'ON THE THIRD,' AND THE OTHER, 'ON THE FIFTH, THEIR EVIDENCE IS INVALID. SIMILARLY, IF ONE TESTIFIES, 'DURING THE SECOND HOUR [OF THE DAY]'<span class="x" onmousemove="('comment',' The length of the day was counted from sunrise to sunset, and having regard to the variation of that period, an hour lasted anywhere between 49 and 71 minutes. ');"><sup>13</sup></span>

From the laws of the commandment is that which they, may their memory be blessed, said (Sanhedrin 40a) that each witness would be investigated with seven investigations, and these are them: In which sabbatical cycle from the seven sabbatical cycles within the jubilee did the event occur that he is testifying about; in which year of the seven years of the sabbatical cycle; in which month of the year; on [which day] of the month; on which day of the six days of the week; at [which hour] of the day; and in what place. And even if he said, "He killed him today," or "yesterday," we ask him all of this.
