בשלמא חייב את הזכאי כגון שנטל ונתן ביד אלא זיכה את החייב היכי משכחת לה דאמר ליה פטור אתה והא לא נטל ונתן ביד כיון דאמר פטור אתה כמו שנטל ונתן ביד דמי
