ואפילו לוה מצי מעכב והאמר ר' אלעזר לא שנו אלא מלוה אבל לוה כופין אותו ודן בעירו

do not three [judges] suffice?— The Mishnah is meant thus: If each party chose a different <i>Beth din</i>, [sothat one is not mutually accepted], they must jointly choose athird.<span class="x" onmousemove="('comment',' But it is not meant that the procedure must be so from the very outset.
