ת"ש כשם שמוכרת שלא בב"ד כך יורשיה יורשי כתובתה מוכרים שלא בבית דין בשלמא למאן דאמר לפי שאין אדם רוצה שתתבזה אשתו בבית דין כי היכי דאיהי לא ניחא ליה דתתבזי יורשיה נמי לא ניחא ליה דליבזו אלא למאן דאמר משום חינא יורשיה מאי חן איכא תרגמה עולא כגון שירשתה בתה או אחותה:

Come and hear: Just as she may sell [her deceased husband's estate] without [the sanction of] the court, so may her heirs, those who inherit her ketubah. This makes sense for the one who says, “Because no man wants his wife to suffer the indignity [of appearing] in court” just as he does not want her to suffer indignity, he also does not want her inheritors to suffer indignity. But to the one who said, “In order to make marriage more attractive” what [consideration for] attractiveness is there for her heirs? Ulla interpreted this [to be a case where] for instance, her daughter or sister inherited her.

Tosefta Ketubot

Just as a widow can sell [her ketubah] without the court, so too can her inheritors [or] those who come with her permission sell [it] without the court. Said Rabbi Shimon: Why did they say that a widow can sell [it] without the court? In order to benefit the orphans, such that they shouldn't plunder their property [if they have to wait to go to court, they will be using up their property in the meantime, so they said that they don't need a court and can sell the ketubah immediately]. If she took possession of a field that was made a security [for her ketubah] and ate it [i.e. used up the value of the property], but profits came out of it—they evaluate for her what she ate, and evaluate for her the profits [just like someone who took possession of a field without permission]. If they evaluate for her in a court, whatever they evaluated is evaluated.
