ר' דוסא בן הרכינס אומר העובר לפני התיבה ביו"ט של ר"ה אומר החליצנו ה' אלהינו את יום ראש החדש הזה אם היום אם למחר ולמחר הוא אומר אם היום אם אמש ולא הודו לו חכמים:

R'JUDAH FURTHER RULED: A MAN MAY CONDITIONALLY<span class="x" onmousemove="('comment',' This is explained infra 39b.');"><sup>22</sup></span> [SET ASIDE TERUMAH]<span class="x" onmousemove="('comment',' Though the setting aside of the priestly dues is forbidden on a day that is definitely known to be a holy day.');"><sup>23</sup></span> FOR A BASKET [OF PRODUCE] ON THE FIRST FESTIVAL DAY [OF NEW YEAR] AND MAY THEN EAT IT ON THE SECOND DAY, AND SO ALSO IF AN EGG WAS LAID ON THE FIRST [FESTIVAL] DAY IT MAY BE EATEN ON THE SECOND; BUT THE SAGES DID NOT AGREE WITH HIM.<span class="x" onmousemove="('comment',' Cf. supra n. 3.');"><sup>24</sup></span>

Teshuvot Maharam

Q. A teacher rendered a decision permitting Jews to instruct a Gentile on the Sabbath to go outside of the city limits in order to be ready to assist relatives of a deceased in their burial operations.
A. The decision of the teacher is incorrect, for ordinarily whatever a Jew is not allowed to do on the Sabbath, he is not permitted to tell a Gentile to do.
This Responsum is addressed to R. Nathan, an uncle of R. Meir. But according to Cr. 20, it was sent to R. Hezekiah of Merseburg.
