Tosefta for Ketubot 51:7
והחולק בבית דין אינה חזקה אי בבית דין לא הויא חזקה היכא הויא חזקה אמר רב ששת הכי קאמר החולק תרומה בנכסי אביו עם אחיו בבית דין אינה חזקה
But he who takes a share through the court, [this] is not a presumption. If through the court it is not a presumption, what is presumption? Sheshet said: This is what he means: One who shares with his brother’s at the court terumah that was part of his father’s property, it is not a presumption.
Tosefta Peah
Rabbi Shimon ben Gamliel says, "Just as the the presumptive status for the priesthood [is established by] the distribution of Terumah on the threshing floors (following Ketubot 25b:2, Steinsaltz tr.), so too, is the presumptive status for the Levites [established by] the distribution of the first tithe on the threshing floors. [However,] the distribution in the court does not [establish] for him the presumption of the priesthood (Ketubot 26a:7).
