Chapter 51

א אקמטרא ככלי בתוך כלי דמי. אמר רבי יהושע בן לוי ס"ת צריך לעשות לו מחיצה עשרה מר זוטרא איקלע לבי רב אשי חזייה לדוכתיה דמר בר רב אשי דמנח ביה ספר תורה ועביד ליה מחיצה עשרה אמר ליה כמאן כרבי יהושע בן לוי אימר דאמר רבי יהושע בן לוי דלית ליה ביתא אחרינא מר הא אית ליה ביתא אחרינא אמר ליה לאו אדעתאי:
1 spread over a chest [containing sacred books] is regarded as a receptacle within a receptacle. R. Joshua b. Levi said : For a scroll of the Torah it is necessary to make a partition of ten [hand breadths]. Mar Zotra paid a visit to Rab Ashe's house, and saw the sleeping accommodation of Mar b. Rab Ashe, whereby a scroll of the Torah was lying and for which he had made a partition of ten handbreadths. He asked him, "According to whose opinion [hast thou done this]?" "According to R. Joshua b. Levi." "Under which circumstances did R. Joshua b. Levi say that ? When there is no other room ; but the master has another room !" He said to him, "I did not think of that."
ב כמה ירחיק מהן ומן הצואה ארבע אמות: אמר רבא אמר רב סחורה אמר רב הונא לא שנו אלא לאחוריו אבל לפניו מרחיק מלא עיניו וכן לתפלה
2 To what distance must he remove himself from it and excrement [if he wishes to read the Shema'] ? Four cubits. Raba said in the name of Rab Sahorah in the name of Rab Huna : This teaching applies only to [excrement which is behind him ; but if it is in front of him, he must remove himself as far as the eye can see it. Similarly is it with the Tefillah.
ג איני והא אמר רפרם בר פפא אמר רב חסדא עומד אדם כנגד בית הכסא ומתפלל הכא במאי עסקינן בבית הכסא שאין בו צואה
3 But it is not so ! For Rafram b. Pappa said in the name of Rab Hisda : A man may stand opposite a privy and say the Tefillah ! With what are we here dealing ? With a privy which does not contain excrement.
ד איני והאמר רב יוסף בר חנינא בית הכסא שאמרו אע"פ שאין בו צואה ובית המרחץ שאמרו אע"פ שאין בו אדם אלא הכא במאי עסקינן בחדתי
4  But that is not so ! For Rab Joseph b. Hannina said : When they speak of a "privy" they mean even one in which there is no excrement, and when they speak of a "bath-house" they mean even one in which there is no person. But with what are we here dealing? With a new one.
ה והא מיבעי ליה לרבינא הזמינו לבית הכסא מהו יש זימון או אין זימון כי קא מיבעי ליה לרבינא למיקם עליה לצלויי בגויה אבל כנגדו לא
5 And lo, Rabina raised the question : How is it with a place which had been designated to be used as a privy? Do we take account of the designation or not ? How is this question of Rabina to be understood ? Whether one may stand in such a place to pray therein, not to pray over against it.
ו אמר רבא הני בתי כסאי דפרסאי אע"ג דאית בהו צואה כסתומין דמו:
6  Raba said : The privies of the Persians, although they may contain excrement, are to be regarded as closed in.
ז <big><strong>מתני׳</strong></big> זב שראה קרי ונדה שפלטה שכבת זרע והמשמשת שראתה נדה צריכין טבילה ורבי יהודה פוטר:
7 MISHNAH A man with a running issue who experienced emission, a menstruous woman from whom the semen has escaped, and a woman who during intercourse experiences the flow require immersion; but R. Judah exempts them therefrom.
ח <big><strong>גמ׳</strong></big> איבעיא להו בעל קרי שראה זיבה לר' יהודה מהו כי פטר רבי יהודה התם בזב שראה קרי דמעיקרא לאו בר טבילה הוא אבל בעל קרי שראה זיבה דמעיקרא בר טבילה הוא מחייב או דילמא לא שנא
8 GEMARA The question was asked : If a Ba'al Keri sees a flow, how is it according to R. Judah's view ? For although R. Judah there [in the Mishnah] exempts the man with a running issue who experienced emission — and such a man originally did not require immersion — but a Ba'al Keri who experiences a flow — and such a man originally did require immersion — does he compel to have immersion ? Or perhaps there is no difference ?
ט תא שמע המשמשת וראתה נדה צריכה טבילה ורבי יהודה פוטר והא משמשת וראתה נדה כבעל קרי שראה זיבה דמיא וקא פטר רבי יהודה ש"מ תני רבי חייא בהדיא בעל קרי שראה זיבה צריך טבילה ורבי יהודה פוטר:
9 Come and hear : A woman who during intercourse experiences the flow requires immersion ; but R. Judah exempts her therefrom. Behold, a woman in these circumstances is identical with a Ba'al Keri who experienced a flow ; and since R. Judah exempts her, conclude [that he exempts him also]. R. Hiyya taught explicitly : A Ba'al Keri who experienced a flow requires immersion ; but R. Judah exempts him therefrom.
י <br><br><big><strong>הדרן עלך מי שמתו</strong></big><br><br>
10 May we return to thee : He whose dead !
יא מתני׳ <big><strong>תפלת</strong></big> השחר עד חצות ר' יהודה אומר עד ד' שעות תפלת המנחה עד הערב רבי יהודה אומר עד פלג המנחה
11 MISHNAH The morning Tefillah [may be said] until midday. R. Judah says: Until the fourth hour. The afternoon Tefillah [may be said] until the evening. R. Judah says : Until the middle of the afternoon.
יב תפלת הערב אין לה קבע ושל מוספים כל היום (ר' יהודה אומר עד ז' שעות):
12 As far the Tefillah of the evening, it has no fixed time. The additional Tefillah [may be said] at any time in the day. R. Judah says : Until the seventh hour.
יג <big><strong>גמ׳</strong></big> ורמינהו מצותה עם הנץ החמה כדי שיסמוך גאולה לתפלה ונמצא מתפלל ביום
13 GEMARA I quote against the Mishnah : The obligation [of the Shema'] is at sunrise, so as to unite the Ge'ullah and the Tefillah, and consequently one says the Tefillah in the day-time!
יד כי תניא ההיא לותיקין דא"ר יוחנן ותיקין היו גומרים אותה עם הנץ החמה
14 For whom is this teaching intended? For the Wetikin; for R. Johanan said: The Wetikin used to finish it with the sunrise.
טו וכ"ע עד חצות ותו לא והאמר רב מרי בריה דרב הונא בריה דר' ירמיה בר אבא אמר רבי יוחנן טעה ולא התפלל ערבית מתפלל בשחרית שתים שחרית מתפלל במנחה שתים
15  As for the rest of the world, [they may say it] until midday. And not beyond that? For Rab Mari b. Rab Huna, the son of R. Jeremiah b. Abba, has said in the name of R. Johanan: If a man erred and omitted to say the Tefillah in the evening, he should say it twice in the morning; [if he omitted it] in the morning, he should say it twice in the afternoon.
טז כולי יומא מצלי ואזיל עד חצות יהבי ליה שכר תפלה בזמנה מכאן ואילך שכר תפלה יהבי ליה שכר תפלה בזמנה לא יהבי ליה
16 One can therefore say the prayer all day long ! Up to midday one receives the reward of having said the Tefillah in its due time; but beyond that, one receives the reward of having said the Tefillah, but not the reward of having said it in its due time.
יז איבעיא להו טעה ולא התפלל מנחה מהו שיתפלל ערבית ב' את"ל טעה ולא התפלל ערבית מתפלל שחרית ב' משום דחד יומא הוא דכתיב (בראשית א, ה) ויהי ערב ויהי בקר יום אחד אבל הכא תפלה במקום קרבן היא וכיון דעבר יומו בטל קרבנו או דילמא כיון דצלותא רחמי היא כל אימת דבעי מצלי ואזיל
17 The question was asked : How is it if one erred and omitted the afternoon Tefillah — shall he say it twice in the evening ? If thou thinkest thou canst answer [by quoting] "If one erred and omitted the evening Tefillah, he should say it twice in the morning," [that is different] because it is one day ; as it is written, "And there was evening and there was morning one day " (Gen. i. 5). But here the Tefillah is the substitute for the sacrifice, and the day having passed, the sacrifice becomes void. Or is it perhaps because Tefillah is supplication, and one may pray whenever he wishes?
יח ת"ש דאמר רב הונא בר יהודה א"ר יצחק א"ר יוחנן טעה ולא התפלל מנחה מתפלל ערבית ב' ואין בזה משום דעבר יומו בטל קרבנו
18 Come and hear: For Rab Huna b. Judah said in the name of R. Isaac, in the name of R. Johanan: If one erred and omitted the afternoon Tefillah, he should say it twice in the evening, and the principle "The day having passed, the sacrifice becomes void" does not apply.
יט מיתיבי (קהלת א, טו) מעות לא יוכל לתקון וחסרון לא יוכל להמנות מעות לא יוכל לתקון זה שבטל ק"ש של ערבית וק"ש של שחרית או תפלה של ערבית או תפלה של שחרית וחסרון לא יוכל להמנות זה שנמנו חביריו לדבר מצוה ולא נמנה עמהם
19  It is quoted in objection, "That which is crooked cannot be made straight, and that which is wanting cannot be numbered" (Eccles. i. 15) — "that which is crooked cannot be made straight," i.e. one who has omitted the Shema' of the evening or morning, or the Tefillah of the evening or morning; "and that which is wanting cannot be numbered," i.e. his companions were numbered for the purpose of a religious duty, and he was not numbered among them!
כ א"ר יצחק א"ר יוחנן הכא במאי עסקינן שבטל במזיד
20 R. Isaac said in the name of R. Johanan: With whom are we here dealing? With one who intentionally omitted [the Shema' or Tefillah].
כא אמר רב אשי דיקא נמי דקתני בטל ולא קתני טעה ש"מ:
21 Rab Ashe said : There is confirmation in the fact that he used the term "omitted" and not "erred." Draw that conclusion.
