Chapter 101

א בידוע שלפני שחיטה לא נמצא עליה קורט דם בידוע שלאחר שחיטה
1 it is certain that [the perforation occurred] before the slaughtering;<span class="x" onmousemove="('comment',' And it is trefah.');"><sup>1</sup></span>
ב הגליד פי המכה בידוע ששלשה ימים קודם שחיטה לא הגליד פי המכה המוציא מחבירו עליו הראיה
2 but if there was not found on it a spot of blood [it is permitted,<span class="x" onmousemove="('comment',' Even though the needle protruded on both sides, since there is no blood clinging to it, the animal is permitted. V. Maim. Yad, Shech, VI, 12; also Asheri a.l. and gloss thereto.');"><sup>2</sup></span>
ג ומאי שנא מכל נקובי דעלמא דאע"ג דליכא דם טריף מר
3 for] it is certain that [the perforation occurred] after slaughtering.
ד התם ליכא מידי למיסרך
4 If the top of th wound was covered with a crust it is certain that the wound occurred at least three days before the slaughtering;<span class="x" onmousemove="('comment',' So that the sale of this animal, if transacted in these three days, is null and void and the purchaser is entitled to a refund of his money.');"><sup>3</sup></span>
ה הכא כיון דאיכא מחט אי איתא דקודם שחיטה הוא מיסרך הוה סריך
5 if it was not covered with a crust then the burden of proof lies upon the claimant.<span class="x" onmousemove="('comment',' There is here a doubt whether the wound occurred before or after the animal had passed from the vendor to the purchaser, and it is for the purchaser who is suing for the return of the purchase money to prove his case, namely, that the animal was already trefah at the time of the sale. ,uhxbf rhypn');"><sup>4</sup></span>

6 Why is this case different from all other cases of perforation of an organ, where the Master declares it to be trefah even though there was not a drop of blood [around the perforation]? - In those cases there was no object to which the blood could cling; here, however, since a needle is impacted [in the reticulum], had it pierced it before the slaughtering some blood would surely have clung to it.
ז חזי מר האי צורבא מרבנן דאתא ממערבא ואמר
7 R'Safra said to Abaye: 'Has my Master seen that scholar who came from the West and who goes by the name of R''Awira?
ח רב עוירא שמני ואמר
8 For he relates that once there came before Rabbi the case of a needle found impacted in the thick wall of the reticulum and which protruded only on one side and he declared it trefah!' Abaye thereupon sent for this scholar, but he would not come; so Abaye went to him.
ט מעשה ובא לפני רבי מחט שנמצאת בעובי בית הכוסות מצד אחד וטרפה
9 He found him on the roof and he called out, 'Would you come down Sir'?
י שלח ליה לא אתא לגביה
10 He would not come down; Abaye then went up to him and said: 'Would you tell me the actual facts of that case? ' He replied.'
יא אזל הוא לגביה
11 I am in charge of the assemblies<span class="x" onmousemove="('comment',' , 'Janitor at the meetings of scholars', Jast.');"><sup>5</sup></span>
יב הוה קאי אאיגרא אמר
12 to His Excellency the Great Rabbi,<span class="x" onmousemove="('comment',' I.e., R. Judah Ha-nasi, the Patriarch (Rashi) . More probably 'Great Rabbi' is a title of dignity when speaking of the head of the Academy. So, tkhgk vkgnk too, the term is evidently a title of honour 'His Excellency'; cf. the parallel Heb. expression, , in Men. 103b. (Glosses of S. H. Dunner) .');"><sup>6</sup></span>

13 and as R'Huna of Sepphoris and R'Jose the Mede were sitting with him there came before Rabbi the case of a needle found impacted in the thick wall of the reticulum.
יד לא נחית
14 It protruded only on one side, but when Rabbi turned it over he found, on the outside [directly above the needle], a spot of blood, so he declared it to be trefah, saying: "If there was no wound there<span class="x" onmousemove="('comment',' I.e., if the needle had not penetrated both walls of the reticulum.');"><sup>7</sup></span>
טו סליק הוא לגביה א"ל
15 whence came the spot of blood"'?
טז אימא לי גופא דעובדא היכי הוה
16 Abaye exclaimed: You caused me a great deal of trouble [all for nothing]! It is expressly stated in our Mishnah, IF THE OMASUM OR RETICULUM WAS PIERCED ON THE OUTSIDE.<span class="x" onmousemove="('comment',' And in the case in question there was sufficient evidence that the needle had pierced both coats of the reticulum.');"><sup>8</sup></span>

17 IF [THE ANIMAL] FELL FROM THE ROOF.
יח מפטיר כנסיות אנא לעילא מרבי רבה והוה רב הונא ציפוראה ורבי יוסי מדאה יושבין לפניו ובאת לפני רבי מחט שנמצאת בעובי בית הכוסות מצד אחד והפכה רבי ומצא עליה קורט דם וטרפה ואמר
18 R'Huna said: If a person left an animal on the roof and when he returned he found it on the ground below, we do not apprehend any lesion of the Internal organs.<span class="x" onmousemove="('comment',' It may be slaughtered immediately and there is no necessity to examine all the internal organs.');"><sup>9</sup></span>
יט אם אין שם מכה קורט דם מנין
19 A goat belonging to Rabina was on the roof and through the sky-light saw some peeled barley below.
כ אמר ליה
20 It jumped and fell down from the roof to the ground.
כא טרח טרייה לההוא גברא מתניתין היא
21 He [Rabina] came before R'Ashi and enquired.
כב המסס ובית הכוסות שניקבו לחוץ:
22 Was the reason for R'Huna's statement, 'If a person left an animal on the roof, and returned and found it on the ground we do not apprehend a lesion of the internal organs', that it had something to hold on,<span class="x" onmousemove="('comment',' And so by clinging to the wall it breaks its fall and it is not so severe. In this case, however, where the goat jumped through the skylight, there were no walls to which it might have clung; accordingly we must apprehend a lesion of the internal organs.');"><sup>10</sup></span>
כג נפלה מן הגג:
23 but in this case it had nothing to hold on; or was it that it estimated the distance,<span class="x" onmousemove="('comment',' And considered it safe for a jump, and therefore there is no fear of any injury to any of the internal organs.');"><sup>11</sup></span>
כד אמר רב הונא
24 so that here too it estimated the distance? - He replied.
כה הניח בהמה למעלה ובא ומצאה למטה אין חוששין משום ריסוקי אברים
25 The reason was that it estimated the distance; so that here too it estimated the distance [and it is therefore permitted].
כו ההוא גדיא דהו"ל לרבינא דחזא חושלא באיפומא דגר נפל מאיגרא לארעא
26 A ewe belonging to R'Habiba was seen dragging along its hind legs.
כז אתיא לקמיה דרב אשי א"ל הא דאמר רב הונא
27 Said R'Yemar, It is suffering from a hip disease.<span class="x" onmousemove="('comment',' A cramp of the hip-joint, sciatica. The animal however is permitted.');"><sup>12</sup></span>
כח הניח בהמה למעלה ובא ומצאה למטה אין חוששין משום ריסוקי אברים משום דאית לה מידי למסרך והאי לית ליה מידי למסרך או דלמא משום דאמדה נפשה והאי נמי אמדה נפשה
28 Rabina demurred, perhaps its spinal cord is severed?
כט אמר ליה
29 It was thereupon examined and was found to be as Rabina had thought.
ל משום דאמדה נפשה והאי נמי אמדה נפשה
30 Nevertheless the law is in accordance with the view of R'Yemar, for a hip disease is a common disorder, whereas the severance of the spinal cord is not common.
לא ההיא אימרתא דהוה בי רב חביבא דהוו שדרן כרעיה בתרייתא אמר רב יימר
31 R'Huna said: In the case of rams that attack each other we do not apprehend any lesion of the internal organs, for although they groan with pain the whole time, [we say] it is merely a fever that has taken hold of them.
לב האי שיגרונא נקטיה
32 But if they were thrown to the ground we certainly apprehend a lesion of the internal organs.
לג מתקיף לה רבינא
33 R'Manasseh said: In the case of rams, stolen by thieves,<span class="x" onmousemove="('comment',' Which are thrown over the fence of the enclosure on to the ground.');"><sup>13</sup></span>
לד ודלמא חוט השדרה איפסיק
34 we do not apprehend any lesion of the internal organs.
לה בדקוה אשכחוה כרבינא
35 Why?
לו ואפ"ה הלכתא כרב יימר שגרונא שכיח חוט השדרה לא שכיח
36 Because when they [the thieves] throw them [over the fence] they throw them in such a manner that they fall on their hips, so that they should run on ahead of them.
לז אמר רב הונא
37 But it they returned them [by throwing them back over the fence], we certainly apprehend a lesion of the internal organs.<span class="x" onmousemove="('comment',' For they care not how the animal falls to the ground.');"><sup>14</sup></span>
לח זכרים המנגחין זה את זה אין חוששין משום ריסוקי אברים אף ע"ג דמידוו וקיימי צימרא בעלמא הוא דנקט להו
38 This is so, however, only if they returned them on account of fear, but if they returned them by way of repentance they would make proper repentance.<span class="x" onmousemove="('comment',' So that when returning them they would take every precaution not to injure the animals.');"><sup>15</sup></span>
לט אי נפול לארעא ודאי חיישינן
39 Rab Judah said in the name of Rab: If a man struck an animal [with a stick] upon the head and the blow reached as far as the tail, or if [he struck it] upon the tail and the blow reached as far as the head, [so that either case the stick came down] upon the entire length of the backbone, we do not apprehend any lesion of the internal organs.
מ אמר רב מנשי
40 If, however, the stick came to an end in the middle of the backbone, we apprehend a lesion of an internal organ;<span class="x" onmousemove="('comment',' particularly an injury to the spinal cord.');"><sup>16</sup></span>
מא הני דכרי דגנבי גנבי אין חוששין משום ריסוק אברים מאי טעמא
41 likewise, if the stick had nodes, or if he struck the animal across the back, we must apprehend a lesion of an internal organ.
מב כי שדו להו אמתנייהו שדו להו כי היכי דלירהטי קמייהו
42 R'Nahman said: [The passage of the young through] the womb cannot cause a lesion of the internal organs.
מג אהדרינהו ודאי חיישינן
43 Said Raba, to R'Nahman: There is [a Baraitha] taught<span class="x" onmousemove="('comment',' Nid. 43b.');"><sup>17</sup></span>
מד והני מילי דאהדרינהו מחמת יראה אבל מחמת תשובה תשובה מעלייתא הוא דעבדי
44 that supports you, viz. , 'A boy, one day old.
מה אמר רב יהודה אמר רב

מו הכה על ראשה והלכה לה כלפי זנבה על זנבה והלכה לה כלפי ראשה כנגד כל השדרה כולה אין חוששין משום ריסוקי אברים

מז ואי שלים חוטרא אפלגי דגבא חיישינן ואי אית בה קיטרי חיישינן ואי מחיי אפסקיה חיישינן
