Chapter 161

א יורשיה יורשי כתובתה חייבין בקבורתה אמר אביי אף אנן נמי תנינא אלמנה ניזונת מנכסי יתומין ומעשה ידיה שלהן ואין חייבין בקבורתה יורשיה יורשי כתובתה חייבין בקבורתה ואיזוהי אלמנה שיש לה שני יורשין הוי אומר זו שומרת יבם
1 it is the duty of her heirs, those who inherit her ketubah, to bury her. Abaye said: We also have learned this in a mishnah: A widow is to be maintained out of the estate of [her deceased husband’s] orphans, and her handiwork belongs to them. They are not obligated to bury her; it is the duty of her heirs, those who inherit her ketubah, to bury her. Now, what widow is it that has two kinds of heirs? I would say she who is awaiting the decision of a levir.
ב אמר רבא ולימא אח אני יורש אשתו אין אני קובר אמר ליה אביי משום דבאין עליו משני צדדין אם אחיו יורש יקבור את אשתו אם אינו קובר את אשתו יתן כתובתה
2 Rava said: But let him say, “I am inheriting my brother; I am not burying his wife!” Abaye replied: Because they come at him from two sides: If he is heir to his brother he should bury his wife; if he does not bury his wife he should return her ketubah.
ג אמר ליה הכי קא אמינא אח אני יורש את אשתו אין אני קובר ואי משום כתובה לא ניתנה כתובה לגבות מחיים
3 Rava responded: This is what I am saying: [The brother could say], “I am inheriting my brother; I am not burying his wife; and if [I am expected to bury her] because of the ketubah, a ketubah is not payable during [the husband’s] lifetime”?
ד מאן שמעת ליה דאית ליה מדרש כתובה בית שמאי ושמעינן להו לב"ש דאמרי שטר העומד לגבות כגבוי דמי
4 From whom did we learn that a midrash may be made on the ketubah? Bet Shammai. But we have also heard Bet Shammai say that a document which is due for payment is regarded as repaid.
ה דתנן מתו בעליהן עד שלא שתו בש"א נוטלות כתובה ולא שותות ובה"א או שותות או לא נוטלות כתובה
5 For we have learned: If their husbands died before they drank, Bet Shammai says that they take their ketubah and that they do not drink, and Bet Hillel say that they either drink or they do not receive their ketubah.
ו או שותות (במדבר ה, טו) והביא האיש את אשתו אל הכהן אמר רחמנא וליכא אלא מתוך שלא שותות לא נוטלות כתובה
6 [How can they say,] “They either drink,” it says in the Torah, “Then the man shall bring his wife to the priest” (Numbers 5:15) and he is not there? Rather, since they cannot drink they do not receive their ketubah.
ז בית שמאי אומרים נוטלות כתובה ולא שותות ואמאי ספיקא הוא ספק זנאי ספק לא זנאי וקאתי ספק ומוציא מידי ודאי
7 Bet Shammai says that they receive their ketubah and that they need not drink. But why [should they receive their ketubah]? This is a claim of a doubtful nature, it being uncertain whether she had committed adultery or not; then how could an uncertainty override a certainty?
ח קסברי בית שמאי שטר העומד לגבות כגבוי דמי
8 Bet Shammai holds that “a document that is due for payment is regarded as repaid.”
ט והא בעינן כשתנשאי לאחר תטלי מה שכתוב ליכי וליכא
9 But do we not require, “When you will be married to another man you will receive what is written for you” and this has not happened?
י אמר רב אשי יבם נמי כאחר דמי:
10 Ashi said: A levir is also regarded as “another man.”
יא שלח ליה רבא לאביי ביד רב שמעיה בר זירא ומי נתנה כתובה לגבות מחיים
11 Rava sent [the following message] to Abaye through R. Shemaya b. Zera: Is the ketubah indeed payable during [the levir’s] lifetime?
יב והתניא ר' אבא אומר שאלתי את סומכוס הרוצה שימכור בנכסי אחיו כיצד הוא עושה אם כהן הוא יעשה סעודה ויפייס אם ישראל הוא מגרש בגט ויחזיר
12 Has it not in fact, been taught: R. Abba stated, “I asked Symmachus: ‘One who wants to sell his brother’s property, how is he to proceed’ [and he replied,] ‘If he is a priest, he should prepare a banquet and use persuasive means.’ If he is an Israelite he may divorce her and then marry her again.’”
