תנא נמי הראשונה קודמת לשניה:

נשא את הראשונה: שמע מינה תלת שמע מינה אחת בחייו ואחת במותו יש להן כתובת בנין דכרין ולא חיישינן לאינצויי

If a man married a first wife. Learn from this three rulings. Learn from this that if one [wife died] during her husband’s lifetime and the other after his death, [the sons of the former] are entitled to the ketubah of “benin dikhrin” and we are not concerned with quarreling.

ממאי מדקתני שניה ויורשיה קודמים ליורשי ראשונה מיקדם הוא דקדמי הא איכא שקלי

From where do we derive this? From that which is taught, “the second wife and her heirs take precedence over the heirs of the first wife;” they take precedence, but if there is enough then [the first sons] take it.

ושמע מינה כתובה נעשית מותר לחברתה

And also learn that the ketubah [of the second wife] may be regarded as the surplus over the other.

ממאי מדלא קתני אם יש שם מותר דינר

From where do we derive this? Since it was not taught [that the first sons collect only] if a surplus of a denar remained there.

ושמע מינה כתובת בנין דכרין לא טרפה ממשעבדי דאי סלקא דעתין טרפה ממשעבדי ליתו בני ראשונה ולטרפינהו לבני שניה

And learn that a benin dikhrin ketubah is not collected from mortgaged property; for if you should think that it is collected from mortgaged property, the sons of the first wife should [be able to] come and take [the property] of the sons of the second.

מתקיף לה רב אשי ממאי דלמא לעולם אימא לך אחת בחייו ואחת במותו אין להן כתובת בנין דכרין ומאי קודמין לנחלה קתני

Rav Ashi raised a difficulty: How do we know this? I could say that if one [wife died] while her husband was alive, and the other after his death, [the sons of the former] are not entitled to the benin dikhrin ketubah. And what does “take precedence” mean? It was taught in reference to inheritance?

וכי תימא יורשי הראשונה למה לי איידי דתנא שניה ויורשיה תנא נמי ליורשי הראשונה

And should you say: Why mention “the inheritors of the first wife”? [I might reply that] since the tanna taught, “the second wife and her inheritors” he also taught of “the inheritors of the first wife.”

ודקאמרת כתובה נעשית מותר לחברתה דלמא לעולם אימא לך אין כתובה נעשית מותר לחברתה והכא הוא דאיכא מותר דינר

And that which you said that “the ketubah [of the second wife] may be regarded as a surplus over the other,” I might say to you that the ketubah is not considered a surplus over the other, but here it is simply a case where there was a surplus of a denar!

ואחת בחייו ואחת במותו תנאי היא דתניא מתו אחת בחייו ואחת במותו בן ננס אומר יכולין בני הראשונה לומר לבני השניה בני בעלת חוב אתם טלו כתובת אמכם וצאו

The case where one [wife died] during her husband’s lifetime and the other after his death, is [a matter in dispute between] tannaim. For it was taught: [If a man’s wives] died, one during his lifetime and the other after his death: Ben Nannas says: The sons of the first can say to the sons of the second, “You are the sons of a creditor, take your mother’s ketubah and go.”

ר' עקיבא אומר כבר קפצה נחלה מלפני בני הראשונה ונפלה לפני בני השניה

R. Akiva says: The inheritance has already been transferred from the sons of the first and landed on the sons of the second.

מאי לאו בהא קא מיפלגי דמר סבר אחת בחייו ואחת במותו יש להן כתובת בנין דכרין ומר סבר אחת בחייו ואחת במותו אין להן כתובת בנין דכרין

Do they not differ on the following principle: One Master holds that where one [wife died] during her husband’s lifetime and the other after his death [the sons of the former] are entitled to their benin dikhrin ketubah, and the other Master holds that where one [wife died] during a husband’s lifetime and the other after his death [the sons of the former] are not entitled to the benin dikhrin ketubah?

אמר רבה אשכחתינהו לרבנן דבי רב דיתבי וקאמרי דכולי עלמא אחת בחייו ואחת במותו יש להן כתובת בנין דכרין והכא בכתובה נעשית מותר לחברתה והוא הדין לבעל חוב קמיפלגי

Rabbah said: I found the rabbis of the academy while they were sitting and arguing: All [hold that where] one [wife died] during her husband’s lifetime and the other after his death [the sons of the former] are entitled to [their mother’s] “benin dikhrin” ketubah, but here they differ [over whether the second wife’s] ketubah may be regarded as a surplus over the other; and the same dispute applies to [the debt] of a creditor.

מר סבר כתובה נעשית מותר לחברתה והוא הדין לבעל חוב ומר סבר אין כתובה נעשית מותר לחברתה והוא הדין לבעל חוב

One Master holds that the [second wife’s] ketubah is regarded as a surplus over the other, and the same law applies to [the debt] of a creditor, and the other Master holds that a ketubah may not be regarded as a surplus over the other, and the same law applies to [the debt] of a creditor.

ואמינא להו אנא בבעל חוב כולי עלמא לא פליגי דהוי מותר כי פליגי בכתובה

And I said to them: In respect of [a claim of] a creditor no one disputes that [the debt] is regarded as a surplus; they only differ in respect of a ketubah.

מתקיף לה רב יוסף אי הכי רבי עקיבא אומר כבר קפצה נחלה אם יש מותר דינר מיבעי ליה

Joseph raised a difficulty: If so [instead of saying,] “R. Akiva said: The inheritance has already been transferred” it should [have said] “If there is a surplus of a dinar [the sons of the first wife receive their mother’s ketubah].”

אלא אמר רב יוסף באחת בחייו ואחת במותו קא מיפלגי

Rather R. Joseph said that they differ [over whether the sons of the first wife receive their mother’s benin dikhrin ketubah when] one [wife died] during her husband’s lifetime and the other after his death.

והני תנאי כי הני תנאי דתניא נשא את הראשונה ומתה נשא את השניה ומת הוא באין בניה של זו לאחר מיתה ונוטלין כתובת אמן ר"ש אומר אם יש מותר דינר אלו נוטלין כתובת אמן ואלו נוטלין כתובת אמן ואם לאו חולקין בשוה

And these tannaim [differ on the same principle] as the following tannaim, as it was taught: If a man married his first wife and she died and then he married his second wife and he died, the sons of this wife may come after [her] death and exact their mother’s ketubah. Shimon ruled: If there is a surplus of one dinar these take their mother’s ketubah, and these take their mother’s ketubah. But if no [such surplus remains] they divide [the remainder] equally.
