Chapter 47

א אימא לא
1 I would not say so.
ב ואי אשמעינן הני תרתי משום דממונא אבל אשת איש דאיסורא אימא לא
2 And if he would let us hear these two [cases I might have said] because [both cases deal with] money matters but [in the case of] “a married woman” which is a matter of [sexual] prohibition I would say no.
ג נשביתי וטהורה אני למה לי משום דקא בעי למיתני ואם משנשאת באו עדים הרי זו לא תצא
3 Why do I need [the case of] “I was taken captive and I am pure”? Because he wants to teach, “But if witnesses came after she got married, she shall not go out.”
ד הניחא למאן דמתני לה אסיפא אלא למאן דמתני לה ארישא מאי איכא למימר משום דקא בעי למיתני שתי נשים שנשבו
4 This goes well according to him who teaches this in reference to the second clause, but according to him who teaches it in reference to the first clause, what is there to say? Because he wants to teach [the case of], “If two women were taken captive.”
ה ושתי נשים שנשבו למה לי מהו דתימא ניחוש לגומלין קמשמע לן
5 And why do I need [the case of] “If two women were taken captive”? What might you have said? Let us be concerned lest they collude, therefore he teaches us [that we are not concerned].
ו וכן שני אנשים למה לי משום דקא בעי למיתני פלוגתא דרבי יהודה ורבנן
6 And also why do I need the case of “and also two men”? Because he wants to teach the dispute between R. Judah and the rabbis.
ז ת"ר אני כהן וחברי כהן נאמן להאכילו בתרומה ואינו נאמן להשיאו אשה עד שיהו ג' שנים מעידין על זה ושנים מעידין על זה רבי יהודה אומר אף אינו נאמן להאכילו בתרומה עד שיהו שלשה שנים מעידין על זה ושנים מעידין על זה
7 Our rabbis taught: [One who says:] I am a priest and my friend is a priest, he is believed in order that others may allow him to eat terumah, but he is not believed that he would be allowed to marry a woman until there are three, [and] two testify to one and two testify to the other. R. Judah says: He is not believed even with regard to allowing him to eat terumah until there are three, [and] two testify to one and two testify to the other.
ח למימרא דרבי יהודה חייש לגומלין ורבנן לא חיישי לגומלין והא איפכא שמעינן להו דתנן החמרין שנכנסו לעיר ואמר אחד מהן שלי חדש ושל חברי ישן שלי אינו מתוקן ושל חברי מתוקן אינו נאמן רבי יהודה אומר נאמן
8 That is to say that R. Judah is concerned about collusion, and the rabbis are not concerned about collusion? But we have heard the opposite, as it is taught: Donkey-drivers who come to a town and one of them says, “Mine is new and my friend’s is old” [or] “Mine has not had tithes removed and my friends has tithes removed”; he is not believed. R. Judah says: He is believed! Ada b. Ahava, in the name of Rav:
ט אמר רב אדא בר אהבה אמר רב מוחלפת השיטה אביי אמר לעולם לא תיפוך בדמאי הקילו רוב עמי הארץ מעשרין הן
9 The statement must be reversed. Abaye said: Indeed, do not reverse it; they were lenient with regard to demai, for most ammei haaretz separate tithes. Rava said:
י אמר רבא דרבי יהודה אדרבי יהודה קשיא דרבנן אדרבנן לא קשיא אלא דרבי יהודה אדרבי יהודה לא קשיא כדשנינן דרבנן אדרבנן לא קשיא כדאמר רבי חמא בר עוקבא בשכלי אומנותו בידו
10 Is the question [only] of R. Judah against R. Judah? Are the rabbis against the rabbis not a difficulty? Rather, R. Judah against R. Judah is not a difficulty as we have [just] explained, [and] the rabbis against the rabbis is not a difficulty for it is as R. Hama b. Ukba said that [it speaks of] when he has his trade-tools in his hand;
