Chapter 54

א מה לי לשקר או דלמא לא אמרינן
1 why would she lie” or do we not say it?
ב ומאי שנא מההוא מעשה דההוא גברא דאגר ליה חמרא לחבריה א"ל לא תיזיל באורחא דנהר פקוד דאיכא מיא זיל באורחא דנרש דליכא מיא ואזל איהו באורחא דנהר פקוד ומית חמרא
2 But why should this be different from the following case of someone who hired out a donkey to a person, and he said to him, “Do not go the way of Nehar Pekod. where there is water, go the way of Naresh, where there is no water.” But he went the way of Nehar Pekod and the donkey died.
ג אתא לקמיה דרבא א"ל אין באורחא דנהר פקוד אזלי מיהו לא הוו מיא אמר רבא מה לי לשקר אי בעי א"ל באורחא דנרש אזלי ואמר ליה אביי מה לי לשקר במקום עדים לא אמרינן
3 He [then] came before Rava and said to him: ‘Indeed, I went the way of Nehar Pekod, but there was no water. Rava: “Why should he lie? If he wished he could have said, “I went the way of Naresh.” And Abaye said to him: We do not say “Why should he lie?’ where there are witnesses.
ד הכי השתא התם ודאי איכא עדים דאיכא מיא הכא ודאי איטמי חששא הוא ובמקום חששא אמרינן:
4 Now is this so? There there were witnesses that there certainly was water on the way of Nehar Pekod, but here has she certainly been defiled? It is [only] a concern, and in the case of a mere concern we do say [“why should he lie?”].
ה אם יש עדים אפילו עבד ואפילו שפחה נאמנין: ואפילו שפחה דידה מהימנא ורמינהי לא תתייחד עמו אלא ע"פ עדים
5 If there are witnesses, even a slave, even a handmaid, they are believed. And even her own handmaid is believed. But we raise a contradiction against this: She should not be secluded with him unless there are witnesses, even a slave,
ו ואפילו ע"פ עבד וע"פ שפחה חוץ משפחתה מפני שלבה גס בשפחתה אמר רב פפי בשבויה הקילו
6 even a handmaid except her own handmaid, because she is familiar with her own handmaid! Papi said: In [the case of] a female captive they were lenient.
ז רב פפא אמר הא בשפחה דידה הא בשפחה דידיה
7 Papa said: In the one case [it speaks of] her handmaid, in the other case [it speaks of] his handmaid.
ח ושפחה דידה לא מהימנא הא קתני אין אדם מעיד על עצמו הא שפחה דידה מהימנא שפחתה נמי כעצמה דמי
8 But is her handmaid really not believed? Does it not teach “No one may testify as to himself?” [Implying] her handmaid is believed! Her handmaid is like herself.
ט רב אשי אמר הא והא בשפחה דידה ושפחה מיחזא חזיא ושתקה התם דשתיקתה מתירתה לא מהימנא הכא דשתיקתה אוסרתה מהימנא
9 Ashi said: In both cases [it speaks of] her handmaid. A handmaid sees and is silent. There, where her silence makes her permitted, she is not believed, but here, where her silence makes her forbidden she is believed.
י השתא נמי אתיא ומשקרא תרתי לא עבדה
10 Now also, she may come and lie? Two [things] she would not do.
יא כי הא דמרי בר איסק ואמרי לה חנא בר איסק אתא ליה אחא מבי חוזאה א"ל פלוג לי בנכסי דאבא א"ל לא ידענא לך אתא לקמיה דרב חסדא א"ל שפיר קאמר לך דכתיב (בראשית מב, ח) ויכר יוסף את אחיו והם לא הכירהו מלמד שיצא בלא חתימת זקן ובא בחתימת זקן
11 As in the case of Mari b. Isak [or as some say of Hana b. Isak], a brother came to him from Be-Hozae and said to him: Give me a share in the property of our father. He answered him: I do not know you. He [then] came to R. Hisda, and he said to him: He answered you well, for it is written: “And Joseph knew his brothers, but they did not know him” (Genesis 22:8) This teaches that he went away before he had grown a beard and he came back after growing a beard.
יב א"ל זיל אייתי סהדי דאחוה את א"ל אית לי סהדי ומסתפינו מיניה דגברא אלמא הוא א"ל לדידיה זיל אייתינהו את דלאו אחוך הוא א"ל דינא הכי המוציא מחבירו עליו הראיה א"ל הכי דאיננא לך ולכולהו אלמי חברך השתא נמי אתו ומשקרי תרתי לא עבדי
12 [Then] he said to him: I Go and bring witnesses that you are his brother. He answered him: I have witnesses, but they are afraid of him, because he is a powerful man. He [then] said to the other man: Go you and bring witnesses that he is not your brother. He answered him: Is this the law? [Surely] he who wishes to extract money from his fellow, must provide the evidence. He said to him: This is how I rule for you and all who are powerful like you! But they might still come and lie? Two things they will not do.
יג לימא כתנאי זו עדות איש ואשה תינוק ותינוקת אביה ואמה ואחיה ואחותה אבל לא בנה ובתה לא עבדה ושפחתה ותניא אידך הכל נאמנין להעיד חוץ מהימנה ובעלה
13 Shall we say that this difference is like that between [these] tannaim? [For it was taught]: This testimony: a man and a woman, a boy and a girl, her father and her mother, her brother and her sister [may testify], but not her son and her daughter, nor her slave and her handmaid. And in another [baraita] it was taught: All are believed to testify [for her] except herself and her husband.
יד דרב פפי ודרב אשי תנאי היא דרב פפא מי לימא תנאי היא
14 Now the views of R. Papi and R. Ashi are [certainly] according to the difference of the Tannaim. But is the view of R. Papa according to the Tannaim?
טו אמר לך רב פפא כי תניא ההיא במסיחה לפי תומה
15 Papa could answer you: When that baraita was taught, it referred to a woman who talked in her simplicity.
טז כי הא דכי אתא רב דימי אמר רב חנן קרטיגנאה משתעי מעשה בא לפני רבי יהושע בן לוי ואמרי לה רבי יהושע בן לוי מישתעי מעשה בא לפני רבי באדם אחד שהיה מסיח לפי תומו ואמר אני ואמי נשבינו לבין העובדי כוכבים יצאתי לשאוב מים דעתי על אמי ללקט עצים דעתי על אמי והשיאה ר' לכהונה על פיו:
16 Like that which R. Dimi said when he came: R. Hanan of Carthage told a story: A case came before R. Joshua b. Levi (or as some say R. Joshua b. Levi told a story: A case came before Rabbi): Someone was talking in his simplicity and said: I and my mother were taken captives among the non-Jews. When I went out to draw my water, my mind was on my mother. [When I was out] to gather wood, my mind was on my mother. And Rabbi allowed her to marry a priest by [the words of] his mouth.
יז <big><strong>מתני׳</strong></big> אמר ר' זכריה בן הקצב המעון הזה לא זזה ידה מתוך ידי משעה שנכנסו עובדי כוכבים לירושלים ועד שיצאו אמרו לו אין אדם מעיד על עצמו:
17 Rabbi Zechariah ben Ha-katzav said: “By this temple! Her hand did not move out of my hand from the time that the non-Jews entered Jerusalem until they departed.” They said to him: “No one may testify concerning himself.”
יח <big><strong>גמ׳</strong></big> תנא ואעפ"כ ייחד לה בית בחצרו וכשהיא יוצאה יוצאה בראש בניה וכשהיא נכנסת נכנסת בסוף בניה
18 GEMARA. It has been taught: And nevertheless, he set aside a house for her in his courtyard, and when she would go out, she went out at the head of her children, and when she would come in, she came in at the head of her children.
יט בעי אביי מהו לעשות בגרושה כן התם הוא דבשבויה הקילו אבל הכא לא או דלמא לא שנא
19 Abaye asked: May one do so with regard to one’s divorcee? [Do I say:] There it was allowed because in [the case of] a captive woman they were lenient, but not here. Or is there no difference?
כ ת"ש דתניא המגרש את אשתו לא תנשא בשכונתו
20 Come and hear: It has been taught: If someone has divorced his wife, she may not get married [and live] in his neighborhood.
