Chapter 16

א מנה אין כאן משכון אין כאן איתיביה רבא לרב נחמן קידשה במשכון מקודשת התם במשכון דאחרים וכדרבי יצחק
1 here is neither a maneh nor a pledge.<span class="x" onmousemove="('comment',' I.e., she neither received the maneh nor did he actually give her a pledge, since that must be returned. [V. Tosaf.; Asheri: Where there is no liability there can be no pledge, for no man can pledge himself for something which he does not owe. Similarly here, since he does not owe her the maneh, for he may retract if he wishes to do so, the pledge is no pledge.]');"><sup>1</sup></span> Raba raised an objection against R'Nahman: 'If he betroths her with a pledge she is betrothed'? - There the reference is to a pledge belonging to others, and it is in accordance with R'Isaac.
ב דאמר רבי יצחק מנין לבעל חוב שקונה משכון שנאמר (דברים כד, יג) ולך תהיה צדקה אם אינו קונה צדקה מנין מכאן לבעל חוב שקונה משכון
2 For R'Isaac said: How do we know that a creditor has a title to a pledge? Because it is written, [And if the man be poor, thou shalt not sleep with his pledge: thou shalt surely restore to him the pledge when the sun goeth down.] and it shall be accounted unto thee a charitable deed:<span class="x" onmousemove="('comment',' Deut. XXIV, 12f.');"><sup>2</sup></span>
ג בני רב הונא בר אבין זבון ההיא אמתא בפריטי לא הוו בהדייהו אותיבי נסכא עליה לסוף אייקר אמתא אתו לקמיה דרבי אמי אמר להו פריטי אין כאן נסכא אין כאן
3 if he has no title thereto, whence is his charity? This proves that the creditor has a title to the pledge.<span class="x" onmousemove="('comment',' It is legally his whilst in his possession. Therefore he may validly offer it as kiddushin.');"><sup>3</sup></span>

4 The sons of R'Huna B'Abin bought a female slave for copper coins. Not having them [the coins] at hand, they gave a silver ingot in pledge.
ה לא מיבעיא קא אמר לא מיבעיא שדיתינהו קמיה דלא הוו קידושין אבל זרקתו לים או לאור אימא כיון דמיחייבא בהו קדושי קדיש נפשה והא דקא עבדא הכי סברא איבדקיה להאי גברא אי רתחנא הוא או לא קמ"ל
5 Subsequently the slave's value increased,<span class="x" onmousemove="('comment',' And the vendor wished to withdraw from the bargain.');"><sup>4</sup></span> so they came before R'Ammi.
ו תנו רבנן התקדשי לי במנה תנם לאבא ולאביך אינה מקודשת על מנת שיקבלום לי מקודשת
6 Said he to them: There are neither coins nor an ingot.<span class="x" onmousemove="('comment',' As on p. 30, n. 6: the coins have not been received, whilst the ingot was not given to effect the purchase. Therefore it can be cancelled.');"><sup>5</sup></span> Our Rabbis taught: [If a man says to a woman,] 'Be thou betrothed unto me with a maneh,' and she takes and throws it into the sea, the fire, or into anything where it is lost, she is not betrothed.
ז תנא אבא להודיעך כח דרישא תנא אביך להודיעך כח דסיפא
7 Then if she throw down before him - it is valid kiddushin? But she [thereby] declares to him, 'Take it: I do not want it!' - He [the Tanna] proceeds to a climax.<span class="x" onmousemove="('comment',' V. p. 28, n. 7.');"><sup>6</sup></span>
ח התקדשי לי במנה תנם לפלוני אינה מקודשת על מנת שיקבלם לי מקודשת וצריכא
8 [Thus:] It is unnecessary [to state that] if she throws it down before him i is not kiddushin; but if she throws it into the sea or the fire, I might argue, Since she is now liable for it, has certainly permitted herself to be betrothed: and the reason that she acted thus was because she thought, 'I will test this man, whether he is hot-tempered or not.' Therefore we are informed [otherwise].
ט דאי אשמעינן אבא ואביך התם הוא דכי אמרה על מנת שיקבלום לי הוו קידושין דסמכה דעתה עילייהו סברה עבדין לי שליחותאי אבל פלוני לא
9 Our Rabbis taught: [If a man says to a woman,] 'Be thou betrothed unto me with a maneh,' [and she replies,] 'Give it to my father' or 'thy father,' she is not betrothed; 'on condition that they accept it for me is betrothed.' My father' is mentioned to shew you how far-reaching is the first clause;<span class="x" onmousemove="('comment',' Even then, she is not betrothed.');"><sup>7</sup></span>
י ואי אשמעינן פלוני הכא הוא דכי אמרה תנם לפלוני לא הוו קידושי דלא מקרבא דעתה לגביה למיתבה ליה במתנה אבל אבא ואביך דמקרבא דעתה לגבייהו אימא במתנה יהביתיה ניהלייהו צריכא
10 'your father,' to shew how far-reaching is the second.<span class="x" onmousemove="('comment',' Even then, she is betrothed.');"><sup>8</sup></span> [If he says] 'Be thou betrothed unto me with a maneh', [and she replies] 'Give it to So-and-so', she is not betrothed.'
יא ת"ר התקדשי לי במנה תנם על גבי סלע אינה מקודשת ואם היה סלע שלה מקודשת בעי רב ביבי סלע של שניהם מהו תיקו
11 On condition that So-and-so accepts it for me', she is betrothed. And both these cases are necessary.
יב התקדשי לי בככר תנהו לכלב אינה מקודשת ואם היה כלב שלה מקודשת בעי רב מרי כלב רץ אחריה מהו
12 For if we were taught the law with respect to 'my father' and 'thy father', [I might have thought that] only there is she betrothed when she replies, on condition that they accept it for me,' because she relies upon them, thinking, 'They will [certainly] act as agents for me'; but in the case of 'So-and-so,' it is not thus. While if we were taught the case of 'So-and-so', [I might have thought that] only there is the kiddushin invalid when she says: 'Give it to So-and-so,' because she Is not sufficiently intimate with him to present it [the maneh] to him as a gift.<span class="x" onmousemove="('comment',' Therefore her reply was a contemptuous rejection of the proposal.');"><sup>9</sup></span>
יג בההוא הנאה דקא מצלה נפשה מיניה גמרה ומקניא ליה נפשה או דלמא מצי אמרה ליה מדאורייתא חיובי מחייבת לאצולן תיקו
13 But as for 'my father' or 'thy father,' with whom she is intimate, I might think that she was making a gift of it to them. Thus both are necessary.
יד התקדשי לי בככר תנהו לעני אינה מקודשת אפילו עני הסמוך עלה מאי טעמא אמרה ליה כי היכי דמחייבנא ביה אנא הכי מחייבת ביה את
14 Our Rabbis taught: [If he says,] 'Be thou betrothed unto me with a maneh,' [and she replies,] 'Place it on a rock', she is not betrothed; but if the rock was hers, she is betrothed. R'Bibi asked: What if the rock belonge to both of them?
טו ההוא גברא דהוה קא מזבין
15 The question stands over. [If he says,] 'Be thou betrothed unto me for a loaf of bread', [and she replies,] 'Give it to the dog', she is not betrothed; but if it was her dog, she is betrothed. R'Mari asked What if the dog was pursuing her? [Do we say that] in return for the benefit of saving herself from it she resolves and cedes herself to him; or perhaps she can say to him, 'By Biblical law you were indeed bound to save me'? The question stands over. [If he says,] 'Be thou betrothed unto me with a loaf,' [and she replies,] 'Give it to the poor man': she is not betrothed, even if he was a poor man who relies on her. Why? - She can say to him, 'Just as I have a duty towards him, so hast thou a duty to him'. A man was selling
