Chapter 20

א מקלט היה כתוב על פרשת דרכים כדי שיכיר הרוצח ויפנה לשם אמר רב כהנא מאי קרא (דברים יט, ג) תכין לך הדרך עשה [לך] הכנה לדרך
1 "'Refuge' was written at crossroads in order that the murderer would recognise it and turn to there [the cities]." Rav Kahana said: "What is [the meaning of] the verse: 'Prepare for yourself the road' (Deuteronomy 19:3)? Make for yourself preparations for the road." [The point is that "prepare"/"takhin" is a word that has multiple meanings. Rav Kahana is clarifying that it should be translated here as "prepare"].
ב רב חמא בר חנינא פתח לה פתחא להאי פרשתא מהכא (תהלים כה, ח) טוב וישר ה' על כן יורה חטאים בדרך אם לחטאים יורה ק"ו לצדיקים
2 Rav Hama var Hanina began a sermon on this section from here: "'The Eternal is good and upright. Therefore, He shows the paths to sinners' (Psalms 25:8). If He shows [the paths] to sinners, all the more so to the righteous!"
ג ר"ש בן לקיש פתח לה פתחא להאי פרשתא מהכא (שמות כא, יג) ואשר לא צדה והאלהים אנה לידו וגו' (שמואל א כד, יד) כאשר יאמר משל הקדמוני מרשעים יצא רשע וגו'
3 Rabbi Shimon ben Lakish began a sermon on this section from here: "'If he didn't lie in wait, and God guided his hand' [and he ends up killing accidentally] (Exodus 21:13). 'As the ancient proverb says, "from the wicked comes wickedness"' (1 Samuel 24:14). What is this verse referring to? With two people that killed someone—one killed accidentally, and one killed intentionally—but for neither of them were there any witnesses,
ד במה הכתוב מדבר בשני בני אדם שהרגו את הנפש אחד הרג בשוגג ואחד הרג במזיד לזה אין עדים ולזה אין עדים הקב"ה מזמינן לפונדק אחד זה שהרג במזיד יושב תחת הסולם וזה שהרג בשוגג יורד בסולם ונפל עליו והרגו זה שהרג במזיד נהרג וזה שהרג בשוגג גולה
4 the Holy Blessed One arranged one marketplace. The one who killed intentionally sits beneath the ladder, and the one who killed accidentally is descending the ladder, and he falls on him and kills him [the murderer]. That one who killed intentionally is killed, and that one who killed accidentally is exiled."
ה אמר רבה בר רב הונא אמר רב הונא ואמרי לה אמר רב הונא א"ר אלעזר מן התורה ומן הנביאים ומן הכתובים בדרך שאדם רוצה לילך בה מוליכין אותו
5 Rabbah bar Rav Huna said (and some say Rav Huna said that Rabbi Elazar said): "From the Torah, from the Prophets, and from the Writings [we can learn that] on the road the a person wants to travel on [to the cities of refuge], they permit him to go.
ו מן התורה דכתיב (במדבר כב, יב) לא תלך עמהם וכתיב (במדבר כב, כ) קום לך אתם מן הנביאים דכתיב (ישעיהו מח, יז) אני ה' אלהיך מלמדך להועיל מדריכך בדרך (זו) תלך מן הכתובים דכתיב (משלי ג, לד) אם ללצים הוא יליץ ולענוים יתן חן
6 From the Torah, as it is written: 'Do not go with them' (Numbers 22:12); and it is written, 'Get up, go with them!' (Numbers 22:20) [regarding Bilaam]; from the Prophets, as it is written: 'I am the Eternal your God who teaches you for your profit, to lead you on the paths that you go' (Isaiah 48:17); from the Writings, as it is written: 'If he is of the scorners, he will scorn; and if he is of the poor, he will be given grace' (Proverbs 3:34)."
ז אמר רב הונא רוצח שגלה לעיר מקלט ומצאו גואל הדם והרגו פטור קסבר (דברים יט, ו) ולו אין משפט מות בגואל הדם הוא דכתיב
7 Rav Huna said: "A murderer that is exiled to a city of refuge, and the blood avenger finds him and kills him—he is exempt." He [Rav Huna] thinks "And for him there is no death penalty" (Deuteronomy 19:6)—about the blood avenger it is written. [Pay close attention to this verse and you will see that it's actually ambiguous, though at first it seems obvious what it means].
ח מיתיבי ולו אין משפט מות ברוצח הכתוב מדבר אתה אומר ברוצח או אינו אלא בגואל הדם כשהוא אומר (דברים יט, ד) והוא לא שונא לו מתמול שלשום הוי אומר ברוצח הכתוב מדבר
8 They challenged [from a baraita]: "'And for him there is no death penalty' (Deuteronomy 19:6)—about the murderer the verse speaks. You say it's about the murderer or perhaps it's actually about the blood avenger? When it says, 'And he didn't hate him recently' (Deuteronomy 19:4)—thus [you would] say that the verse is speaking about the murderer." [Just as the earlier phrase "he didn't hate him" is clearly referring to the murderer, so too when the phrase appears in verse 6 it is also referring to the murderer. Thus the rest of the verse should also be read as referring to the murderer].
ט הוא דאמר כי האי תנא דתניא ולו אין משפט מות בגואל הדם הכתוב מדבר אתה אומר בגואל הדם הכתוב מדבר או אינו אלא ברוצח כשהוא אומר (דברים יט, ו) כי לא שונא הוא לו מתמול שלשום הרי רוצח אמור הא מה אני מקיים ולו אין משפט מות בגואל הדם הכתוב מדבר
9 He [Rav Huna] said according to this tanna, as it is taught [in a baraita]: "'And for him there is no death penalty' (Deuteronomy 19:6)—about the blood avenger the verse speaks. You say it's about the blood avenger or maybe the verse is actually speaking about the murderer? When it says, 'Since he didn't hate him recently' (Deuteronomy 19:6)—this is speaking about the murderer, [but then] how can I uphold 'and for him there is no death penalty'? [This should have been obvious because it has already been established by the fact that he's a manslayer!]. [Therefore], the verse speaks about the blood avenger."
י תנן מוסרין לו שני ת"ח שמא יהרגנו בדרך וידברו אליו מאי לאו דמתרו ביה דאי קטיל בר קטלא הוא
10 It was taught [in a Mishnah]: "They handed him [the manslayer] over to two students of the Sages lest he [the blood avenger] kill him on the road, and they will speak to him." Is it not so that they are warning him that if he kills [the manslayer] he would be liable for the death penalty?
יא לא כדתניא וידברו אליו דברים הראוים לו אומרים לו אל תנהג בו מנהג שופכי דמים בשגגה בא מעשה לידו ר"מ אומר הוא מדבר ע"י עצמו שנאמר (דברים יט, ד) וזה דבר הרוצח אמרו לו הרבה שליחות עושה
11 No! It is like as it is taught [in a baraita]: "And they speak to him words appropriate to him, saying to him: 'Do not do this practice of shedding blood! It was accidentally that the deed came to his hand!' Rabbi Meir says: 'He speaks for himself, as it is said: "And this is the word (davar) of the murderer" (Deuteronomy 19:4)' [lit. this is the matter (davar) of the murderer]. They [the rabbis] said to him: There is much that an agent can accomplish (that he alone would not be able to do).
יב אמר מר בשגגה בא מעשה לידו פשיטא דאי במזיד בר גלות הוא אין
12 Mar [the tannah] had just said, 'It was accidentally that the deed came to his hand' Isn't this obvious!? If it was willfully would he be subject to exile? Yes,
יג והא תניא ר' יוסי בר' יהודה אומר בתחלה אחד שוגג ואחד מזיד מקדימין לערי מקלט וב"ד שולחין ומביאין אותם משם
13 It's as was taught in a baraisa, Rebbi Yosi bar Yehuda says, Initially, both accidental [murderers] and wilful [murderers] would proceed to the cities of refuge, and the court would summon them from there,
יד מי שנתחייב מיתה הרגוהו שנאמר (דברים יט, יב) ושלחו זקני עירו ולקחו אותו משם ונתנו אותו ביד גואל הדם ומת מי שלא נתחייב פטרוהו שנאמר (במדבר לה, כה) והצילו העדה את הרוצח מיד גואל הדם מי שנתחייב גלות מחזירין אותו למקומו שנא' (במדבר לה, כה) והשיבו אותו העדה אל עיר מקלטו אשר נס שמה
14 Whomever was liable to execution they would execute, as the Torah says (Deuteronomy 19,12), "and the elders of his city would and send for him, and take him from there, and place him in the clutches of the goal hadam, and he would die". Whomever was not liable, they would exonerate, as the Torah says (Numbers 35, 25), "and the congregation would save the murderer from the hands if the goal hadam". Whomever was liable for exile, they would return to his place, as the Torah says (Numbers 35, 25), "and that congregation will return him to his city of refuge which he had fled to".
טו רבי אומר מעצמן הן גולין כסבורין הן אחד שוגג ואחד מזיד קולטות והן אינן יודעין שבשוגג קולטות במזיד אינן קולטות
15 Rebbi says, They exile themselves, because they had thought that both accidental and willful [murderers] are protected [by the cities of refuge], but the didn't know that only accidental [murderers] are protected and willful [murderers] aren't protected.
טז א"ר אלעזר עיר שרובה רוצחים אינה קולטת שנאמר (יהושע כ, ד) ודבר באזני זקני העיר ההיא את דבריו ולא שהושוו דבריהן לדבריו
16 Rebbi Elezar says, a city that is mostly murderers does not provide protection as the Torah says (Joshua 20,4) "And he should speak his matter into the ears of the elders city" And not that his matter should be the same as theirs.
יז וא"ר אלעזר עיר שאין בה זקנים אינה קולטת דבעינן זקני העיר וליכא איתמר עיר שאין בה זקנים רבי אמי ור' אסי חד אומר קולטת וחד אומר אינה קולטת למאן דאמר אינה קולטת בעינן זקני העיר וליכא למאן דאמר קולטת מצוה בעלמא
17 And Rebbi Elezar also said, a city that has no elders does not provide protection because we need "elders of the city", and they are lacking. It was said, a city that has no elders [is subject to a dispute between] Rebbi Ami and Rebbi Assi. One says, It provides protection. And one says, It does not provide protection. According to the opinion that it doesn't provide protection, we need "elders of the city" and they are lacking. According to the opinion that it does provide protection, it is just a mitzvah [to use elders].
יח ועיר שאין בה זקנים ר' אמי ורבי אסי חד אמר נעשה בה בן סורר ומורה וחד אמר אין נעשה בה בן סורר ומורה למ"ד אין נעשה בה בן סורר ומורה בעינן (דברים כא, יט) זקני עירו וליכא למ"ד נעשה בה בן סורר ומורה מצוה בעלמא
18 And a city that has no elders [is subject to a dispute between] Rebbi Ami and Rebbi Assi. One says, It can make a ben sorer omorer [a rebellious son]. And one says, It can not make a ben sorer omorer. According to the opinion that it can not make a ben sorer omorer, we need "elders of the city" and they are lacking. According to the opinion that it can make a ben sorer omorer, it is just a mitzvah [to use elders].
יט ועיר שאין בה זקנים ר' אמי ור' אסי חד אמר מביאה עגלה ערופה וחד אמר אינה מביאה עגלה ערופה למ"ד אינה מביאה עגלה ערופה בעינן (דברים כא, ג) זקני העיר ההיא וליכא למאן דאמר מביאה עגלה ערופה מצוה בעלמא
19 And a city that has no elders [is subject to a dispute between] Rebbi Ami and Rebbi Assi. One says, It can bring an eglah arufah [a decapitated cow]. And one says, It can not bring an eglah arufah. According to the opinion that it can not bring an eglah arufah, we need "elders of the city" and they are lacking. According to the opinion that it can bring an eglah arufah, it is just a mitzvah [to use elders].
כ א"ר חמא בר חנינא מפני מה נאמרה פרשת רוצחים
