Megillah 54

Chapter 54

א חבר עיר אבל יש שם חבר עיר תינתן לחבר עיר וכ"ש דעניי דידי ודידכו עלי סמיכי:
1 but if there is a scholar in charge [of charity] there, it should be given to the town scholar, and all the more so in this case, seeing that both my poor and your poor depend upon me.
ב <big><strong>מתני׳</strong></big> אין מוכרין את של רבים ליחיד מפני שמורידין אותו מקדושתו דברי רבי מאיר אמרו לו א"כ אף לא מעיר גדולה לעיר קטנה:
2 They may not sell [something] belonging to a community because this lowers its sanctity, the words of Rabbi Meir. They said to him: if so, it should not be allowed to sell from a larger town to a smaller one.
ג <big><strong>גמ׳</strong></big> שפיר קאמרי ליה רבנן לר"מ ור"מ מעיר גדולה לעיר קטנה מעיקרא קדישא השתא נמי קדישא מרבים ליחיד ליכא קדושה
3 GEMARA. The rabbis gave a good response to R. Meir? And R. Meir [what would he say]? [To sell] from a large town to a small one [is unobjectionable], because if it was holy to begin with, it is still holy now. But if it goes from a community to an individual, there is no holiness left.
ד ורבנן אי איכא למיחש כי האי גוונא נמי איכא למיחש משום (משלי יד, כח) ברוב עם הדרת מלך:
4 And what about the rabbis? If there is cause for concern, then there would be cause for concern in this case as well because “The glory of the king is in the presence of the multitudes” (Proverbs 14:28).
ה <big><strong>מתני׳</strong></big> אין מוכרין בית הכנסת אלא על תנאי שאם ירצו יחזירוהו דברי ר"מ וחכ"א מוכרין אותו ממכר עולם חוץ מארבעה דברים למרחץ ולבורסקי לטבילה ולבית המים ר' יהודה אומר מוכרין אותה לשם חצר והלוקח מה שירצה יעשה:
5 They may not sell a synagogue except with the stipulation that it may be bought back whenever they want, the words of Rabbi Meir. But the sages say: they may sell it in perpetuity, except for four purposes for it to become one of four things: a bathhouse, a tannery, a ritual bath, or a urinal. Rabbi Judah says: they may sell it to be a courtyard, and the purchaser may do what he likes with it.
ו <big><strong>גמ׳</strong></big> ולר"מ היכי דיירי בה הא הויא לה רבית
6 GEMARA. According to R. Meir’s ruling, how do people live in it? [The rent they pay] would be interest!
ז א"ר יוחנן ר"מ בשיטת ר"י אמרה דאמר צד אחד ברבית מותר
7 Yohanan said: R. Meir follows the view of R. Judah, who said that interest which is only contingent is permitted,
ח דתניא הרי שהיה נושה בחבירו מנה ועשה לו שדהו מכר בזמן שמוכר אוכל פירות מותר לוקח אוכל פירות אסור
8 as it has been taught: ‘If a man lent another a man a 100 zuz and the latter made a [conditional] sale to him of his field, if the seller takes the produce, this is permitted, but if the purchaser takes the produce, it is forbidden.
ט ר' יהודה אומר אפילו לוקח אוכל פירות מותר וא"ר יהודה מעשה בביתוס בן זונן שעשה שדהו מכר על פי ראב"ע ולוקח אוכל פירות היה אמרו לו משם ראיה מוכר אוכל פירות היה ולא לוקח
9 Judah said: Even if the purchaser takes the produce it is permitted. Judah further said: It happened once that Baitus b. Zunin made a sale of his field with the permission of R. Elazar b. Azariah, and the purchaser took the produce. They said to him: Do you cite that as a proof? It was in fact the seller who took the produce and not the purchaser.
י מאי בינייהו צד אחד ברבית איכא בינייהו מר סבר צד אחד ברבית מותר ומר סבר צד אחד ברבית אסור
10 What do they argue about? They differ on the question of contingent interest; one authority [R. Judah] held that contingent interest is permitted, and the other held that it is forbidden.
יא רבא אמר דכ"ע צד אחד ברבית אסור והכא רבית ע"מ להחזיר איכא בינייהו מר סבר רבית ע"מ להחזיר מותר ומר סבר אסור:
11 Rava said: All agree that contingent interest is forbidden, and they differ on taking interest on condition of returning it. One authority [R. Judah] held that to take interest on condition of returning it is permitted, while the other held that it is forbidden.
יב וחכ"א מוכרין אותו ממכר עולם וכו': אר"י אמר שמואל מותר לאדם להשתין מים בתוך ד' אמות של תפלה
12 The sages say he may sell it permanently etc. Rav Judah said in the name of Shmuel: It is permitted for a man to urinate within four cubits of where prayers have been said.
יג אמר רב יוסף מאי קמ"ל תנינא ר' יהודה אומר מוכרין אותה לשום חצר ולוקח מה שירצה יעשה ואפילו רבנן לא קאמרי אלא בית הכנסת דקביע קדושתיה אבל ד"א דלא קביע קדושתייהו לא
13 Joseph said: What has he told us? We have already learned it: R. Judah says: it may be sold for use as a courtyard, and the purchaser may do what he likes in it; and even the rabbis did not forbid except for in the synagogue itself, since its sanctity is permanent, but for the four adjoining cubits, the sanctity of which is not permanent, they did not make such a rule.
יד תני תנא קמיה דרב נחמן המתפלל מרחיק ד"א ומשתין והמשתין מרחיק ד"א ומתפלל
14 A tanna recited in the presence of R. Nahman: One who has just said prayers should go a distance of four cubits and urinate, and one who has urinated should go a distance of four cubits and pray.
טו א"ל בשלמא המשתין מרחיק ד"א ומתפלל תנינא כמה ירחיק מהן ומן הצואה ד"א
15 He said to him: I grant you that that one who has urinated should go four cubits and pray, for we have taught this: How far should he go away from it and from excrement? Four cubits. But why should one who has prayed have to go four cubits before urinating?
טז אלא המתפלל מרחיק ד"א ומשתין למה לי אי הכי קדשתינהו לכולהו שבילי דנהרדעא תני
16 If that is the rule, you have sanctified all the streets of Nehardea! Rather teach,
יז ישהה בשלמא משתין ישהה כדי הילוך ד"א משום ניצוצות אלא מתפלל ישהה כדי הילוך ד"א ל"ל אמר רב אשי שכל ד"א תפלתו סדורה בפיו ורחושי מרחשן שפוותיה:
17 “He should wait [the time it takes to go four cubits]”. I grant you that one who has urinated should wait till he can go four cubits [before praying], on account of drippings [on his clothes]. But why should one who has just prayed wait long enough to go four cubits? Ashi replied Because for the time it takes to go four cubits his mouth is still full of his prayer and his lips are still muttering it.

יט שאלו תלמידיו את רבי זכאי במה הארכת ימים אמר להם מימי לא השתנתי מים בתוך ד"א של תפלה ולא כניתי שם לחבירי ולא ביטלתי קידוש היום אמא זקינה היתה לי פעם אחת מכרה כפה שבראשה והביאה לי קידוש היום
19 Zakai was asked by his disciples: How have you lived so long? He said to them: I never urinated within four cubits of a place where prayers have been said, and I never called a friend by his nickname, nor have I omitted performing Kiddush [the sanctification of the day.] I had a grandmother who once sold her head covering so as to bring me [wine for] Kiddush.
כ תנא כשמתה הניחה לו ג' מאות גרבי יין כשמת הוא הניח לבניו שלשת אלפים גרבי יין
20 It was taught: When she died she left him three hundred barrels of wine, and when he died he left his sons three thousand barrels.
כא רב הונא הוה אסר ריתא וקאי קמיה דרב אמר ליה מאי האי א"ל לא הוה לי קידושא ומשכנתיה להמיינאי ואתאי ביה קידושא א"ל יהא רעוא דתיטום בשיראי
21 Huna once came before Rav girded with a string. He said to him: What is this? He replied: I had no [wine for] Kiddush, and I used my girdle as a pledge so as bring [wine] for Kiddush. He said: May it be the will of Heaven that you be [one day] smothered in robes of silk.
כב כי איכלל רבה בריה רב הונא איניש גוצא הוה גנא אפוריא אתיין בנתיה וכלתיה שלחן ושדיין מנייהו עליה עד דאיטום בשיראי שמע רב ואיקפד אמר מאי טעמא לא אמרת לי כי ברכתיך וכן למר
22 When his son Rabbah was getting married, R. Huna, who was a short man, was lying on a bed and his daughters and daughters-in-law stripped [clothes] from themselves and threw them on him until he was smothered in silks. When Rav heard he was angry and said: Why when I blessed you did you not say, The same to you, Master?
כג שאלו תלמידיו את ר"א בן שמוע במה הארכת ימים אמר להם מימי לא עשיתי קפנדריא לב"ה ולא פסעתי על ראשי עם קדוש ולא נשאתי כפי בלא ברכה
23 Elazar b. Shammua was asked by his disciples: How have you lived so long? He replied: Never in my life have I made a short cut through a synagogue, nor have I stepped upon the heads of the holy people, nor have I lifted my hands [to say the priestly blessing] without reciting a blessing.
כד שאלו תלמידיו את ר' פרידא במה הארכת ימים אמר להם מימי לא קדמני אדם לבית המדרש
24 Peridah was asked by his disciples: How did you live such a long life? He replied: My whole life no one came to the Bet Midrash before me,
