Halakhah for Makkot 37:5
ת"ל (דברים טז, ז) ואכלת [שם] לפני ה' אלהיך וגו' מקיש מעשר לבכור מה בכור אינו אלא לפני הבית אף מעשר אינו אלא לפני הבית ואם איתא ליפרוך מה לבכורים שכן טעונין קרייה והנחה
Therefore the Torah teaches us with (Deutermony 16,7) "And you shall eat them before Hashem your God", juxtaposing maaser to bechor. Just as bechor is only possible in the time of the Temple, so too is Maaser only possible in the time of the Temple. And if this is was true [that the recital was essential for Bikorim] then we should have asked What comparison can be made to Bikorim which need both recital and placement?

He prohibited one who puts out a bad name [upon his wife] from divorcing [her]. And that is His saying, "he shall not be able to send her away all of his days" (Deuteronomy 22:19). And this negative commandment was also preceded by a positive commandment; and that is His saying, "and to him shall she be as a wife." And the law for him with divorce, concerning lashes, is the same as the law for the rapist, as has been explained at the end of Makkot and in the third and fourth [chapters] of Ketuvot. (See Parashat Ki Tetzeh; Mishneh Torah, Virgin Maiden 3.)
