Midrash for Makkot 18:9

ר' יוסי אומר השונא נהרג כו': והא לא אתרו ביה מתניתין רבי יוסי בר יהודה היא דתניא רבי יוסי בר יהודה אומר חבר אינו צריך התראה לפי שלא ניתנה התראה אלא להבחין בין שוגג למזיד:

"Rabbi Yose says: The hater is killed." etc. But they didn't warn him? [In order to be executed in Jewish law, one has to be warned that their action is punishable by death by two witnesses]. Our mishnah is Rabbi Yose bar Yehudah, as it is taught [in a baraita]: Rabbi Yose bar Yehudah says: "A colleague does not need warning because warning was only given to distinguish between accidental and intentional." [And we assume that colleagues know the law and are thus, if sinning, sinning intentionally].

Sifrei Devarim

(Devarim 19:11) "and he rise up against him, etc." (Ibid. 12) "Then the elders of his city shall send, and they shall take him from there": From here R. Yossi b. Yehudah says: If one slays a soul, whether unwittingly or wittingly — all proceed to the cities of refuge, and beth-din send and bring him from there.
