Midrash for Sanhedrin 41:4

<big><strong>גמ׳</strong></big> למימרא דר' יהודה דריש טעמא דקרא ור"ש לא דריש טעמא דקרא והא איפכא שמעינן להו

Judah permits it, where the feared consequences will not follow; whilst R. Simeon keeps to the letter of the law.
