אמר ליה אביי וטעמיה דרבי יהודה הכא שלא יהא חוטא נשכר הוא והא תניא ר' יהודה אומר שבויה שנשבית הרי היא בקדושתה אפי' בת עשר שנים כתובתה מאתים והתם מאי שלא יהא חוטא נשכר איכא התם נמי דלמא מימנעי ולא נסבי לה

Abaye answered him: Is R. Judah’s reason here “that the sinner should gain no advantage”? has it not been taught: R. Judah says, “If a female captive was ransomed she remains in her state of holiness, and even if she is ten years old her kethubah is two hundred zuz.” Now how [could the reason] “that the sinner should gain no advantage” apply there? There also [a good reason exists for R. Judah’s ruling, since otherwise men] would refrain from marrying her.

Tosefta Ketubot

Rabbi Yehudah says: A minor daughter of Israel who was captured, even if she is 10 years' old, she is in her holiness and her ketubah stands. A man who has sex with a deaf-mute woman, with an insane woman, with an adult woman and with a woman who lost her virginity not through sex (mukkat etz)—they do not have the fine [proscribed by the Torah]. A blind woman and a woman incapable of having children—they have the fine.
