Chapter 110

א ובתרומת מעשר של דמאי
1 and in that of terumah of the tithe of demai produce.
ב ורב לא אזיל בתר אומדנא והא איתמר מתנת שכיב מרע שכתוב בה קנין בבי רב משמיה דרב אמרי ארכביה אתרי רכשי ושמואל אמר לא ידענא מאי אידון בה
2 But Rav does not follow [the rule of] assumption? Surely it was stated: As to the gift of a dying man [in the deed of] which was recorded a [symbolic] acquisition: The school of Rav in the name of Rav said: Ride him on two harnessed horses; But Shmuel said: I do not know how to decide on the matter.
ג בבי רב משמיה דרב אמרי ארכביה אתרי רכשי הרי היא כמתנת בריא והרי היא כמתנת שכיב מרע
3 ‘The school of Rav in the name of Rav said: Ride him on two harnessed horses” for it is like the gift of a man in good health, and it is also like the gift of a dying man.
ד הרי היא כמתנת בריא דאם עמד אינו יכול לחזור בו הרי היא כמתנת שכיב מרע שאם אמר הלואתי לפלוני הלואתו לפלוני
4 It is like the gift of a man in good health in that, if he recovered, he cannot retract, and it is like the gift of a dying man in that, if he said that his loan [shall be given] to X, his loan [is to be given] to X.
ה ושמואל אמר לא ידענא מאי אידון בה שמא לא גמר להקנותו אלא בשטר ואין שטר לאחר מיתה
5 But Shmuel said: I do not know how to decide on the matter, since it is possible that he decided not to transfer possession to him except through the deed, and there can be no deed after death.
