Chapter 152

א כלה בבית אביה מי דמי התם מייתי אב ראיה ומפיק הכא מייתי בעל החמור ראיה ומוקים
1 the one concerning a bride in her father's house, are the two cases similar? There it is the father who produces the proof and receives [the ketubah from the husband] while here it is the owner of the donkey who produces the proof and keeps [the cow].
ב א"ר אבא כלה בבית חמיה ואכתי לא דמי התם בעל מייתי ראיה ומרע ליה לחזקיה דאב הכא בעל החמור מייתי ראיה ומוקים חזקיה בידיה
2 R. Abba said: [The ruling concerning a] bride in her father-in-law's house. But [the two cases] are still not similar, for there it is the husband who produces the proof and thereby impairs the presumption of the father, while here it is the owner of the donkey who produces the proof and thereby confirms his presumption!
ג אמר רב נחמן בר יצחק כלה בבית אביה ולקדושין
3 R. Nahman b. Yitzchak said: It is similar to the case of the bride in her father's house in respect of her token of betrothal.
ד ולא תימא אליבא דמ"ד קדושין לאו לטיבועין ניתנו אלא אפילו למ"ד קדושין לטיבועין ניתנו הני מילי קידושי ודאי אבל קידושי טעות אי מייתי ראיה אין אי לא לא
4 And, do not say [that this applies only] in accordance with him who holds [that a token of] betrothal is not unreturnable but [it holds good] even according to him who maintains [that a token of] betrothal is unreturnable, since his ruling relates only to certain betrothal, but [not] to doubtful betrothal, where if he brings proof, he may keep the betrothal, if not, not.
ה מיתיבי מחט שנמצאת בעובי בית הכוסות מצד אחד כשרה משני צדדין טריפה נמצא עליה קורט דם בידוע שהוא לפני שחיטה לא נמצא עליה קורט דם בידוע שהוא לאחר שחיטה
5 An objection was raised: If a needle was found in the thick walls of the second stomach [of a beast that had been properly slaughtered and it protrudes only] from one of its sides, the beast is kosher; [but if it protruded] from both sides, the beast is terefah. If a drop of blood was found on [the needle] it is certain that [the wound was inflicted] before the ritual killing; if no drop of blood was found on it, it is certain that [the wound was made] after the killing.
ו הוגלד פי המכה בידוע ששלשה ימים קודם שחיטה לא הוגלד פי המכה המוציא מחבירו עליו הראיה ואי יהיב טבח דמי בעי לאיתויי ראיה ומפיק
6 If the top of the wound was covered with a crust, it is certain that [the wounding occurred] three days prior to the killing; if the top of the wound was not covered with a crust, the burden of the proof is on the claimant. Now if the butcher had already paid the price he would have to produce the required proof and so retrieve his money? Let
ז ואמאי בעל בהמה לייתי ראיה ונוקים
7 the owner of the beast rather produce the proof and retain [the purchase money]!
ח בדלא יהיב טבחא דמי מאי פסקא
8 [This is a case] where the butcher has not yet paid the price. How can you be so sure?
ט אלא כי אתא רמי בר יחזקאל אמר לא תצייתינהו להני כללי דכייל יהודה אחי משמיה דשמואל הכי אמר שמואל כל שנולד ספק ברשותו עליו הראיה ותנא תונא כלה
9 Rather, when Rami b. Yehezkel came he said, “Pay no regard to those rules which my brother Judah laid down in the name of Shmuel; for thus said Shmuel: He in whose domain the doubt first arose must produce the proof; and the Tanna [of our Mishnah who taught about] the bride provides support for this ruling.
י מיתיבי מחט שנמצאת בעובי בית הכוסות כו' ואי דלא יהיב טבח דמי בעל בהמה בעי לאיתויי ראיה ומפיק ואמאי ספיקא ברשות טבח איתייליד
10 An objection was raised: If a needle was found in the thick walls of the second stomach etc. Now, if the butcher has not yet paid the purchase price it would be the owner of the beast who would have to produce the proof and so extract [its price] from [the butcher]; But why? [Has not] the doubt arisen [when the beast was already] in the possession of the butcher?
יא דיהיב טבח דמי ומאי פסקא סתמא דמילתא כמה דלא יהיב איניש זוזי לא יהיב איניש חיותא:
11 [This is a case] where the butcher has already paid the price. But how can you be so sure? It is the usual practice that so long as one man does not pay the price the other does not give his beast.
יב וחכמים אומרים בד"א במומין שבסתר: אמר רב נחמן
12 The sages say: this applies only to concealed bodily defects. R. Nahman stated:
