For instance, where it was found that one of the fields did not belong to him, and with regard to a creditor of a later date who preceded [one of an earlier date] and collected [the debtor’s property].

The first tanna holds that that which he collected was not legally collected,

(אמר) ר"נ אמר רבה בר אבוה דכולי עלמא מה שגבה לא גבה והכא בחיישינן שמא תכסיף קמיפלגי

Nahman said in the name of Rabbah b. Abbuha: Both agree that that which he collected was not legally collected, but here they differ over whether we are concerned lest the fourth woman let [the ground] deteriorate.

מר סבר חיישינן שמא תכסיף ומר סבר לא חיישינן שמא תכסיף

One Master holds that we must be concerned lest she let the ground deteriorate, whereas the other master is not concerned lest she let the ground deteriorate.

אביי אמר דאביי קשישא איכא בינייהו דתני אביי קשישא יתומים שאמרו גדולים ואין צ"ל קטנים

Abaye said: The difference between them is the ruling of Abaye the Elder who said: The “orphans” of which they spoke are adults and there is no need to even say that minors [are included].

אמר רב הונא הני תרי אחי ותרי שותפי דאית להו דינא בהדי חד ואזל חד מינייהו בהדיה לדינא לא מצי אידך למימר ליה את לאו בעל דברים דידי את אלא שליחותיה עבד

Huna stated: If two brothers or two partners had a lawsuit against a third party and one of them went with that person to the court, the other cannot say to him, “You are not my party” for he has acted as his agent.

Nahman once visited Sura and they asked him what the law was in such a case.

אמר להו מתני' היא הראשונה נשבעת לשניה ושניה לשלישית ושלישית לרביעית ואילו ראשונה לשלישית לא קתני מאי טעמא לאו משום דשליחותה עבדה

He said to them: This is like a mishnah: the first must take an oath to the second, the second to the third and the third to the fourth, but it was not stated, “the first to the third.” What is the reason? Is it not because [the second] has acted as her agent.

מי דמי התם שבועה לאחד ושבועה למאה הכא אמר אילו אנא הואי טעיננא טפי

But are [the two cases] alike? In that case, an oath for one person is the same as an oath for a hundred, but in this case he might well say, “Had l been present I would have made more convincing arguments.”

ולא אמרן אלא דלא איתיה במתא אבל איתיה במתא איבעי ליה למיתי:

This applies only when he was not in town, but if he was in town he should have come to the court.

It was stated: Two deeds bearing the same date: Rav said: They should be divided [between the two claimants], and Shmuel said: [The case is to be decided at] the discretion of the judges.
