פוסקין מזונות לאשת איש ושמואל אמר אין פוסקין מזונות לאשת איש אמר שמואל מודה לי אבא בשלשה חדשים הראשונים לפי שאין אדם מניח ביתו ריקן
They make an allowance of maintenance for a married woman. But Shmuel said: They do not make an allowance of maintenance for a married woman. Shmuel said: Abba agrees with me [that no allowance is to be granted] during the first three months, because no man leaves his house empty.
בששמעו בו שמת כולי עלמא לא פליגי כי פליגי בשלא שמעו בו שמת רב אמר פוסקין דהא משועבד לה ושמואל אמר אין פוסקין
In a case where they heard that he died they do not argue. They only differ when they did not hear that he had died. Rav said: They make an allowance for he is obligated to maintain her. Shmuel said: They do not make an allowance.
מ"ט רב זביד אמר אימא צררי אתפסה רב פפא אמר חיישינן שמא אמר לה צאי מעשה ידיך במזונותיך
What is Shmuel’s reasoning? Rav Zevid said: Because I might say that he gave over to her some bundles. Papa said: We must be concerned that he told her, “Deduct [the proceeds of] your handiwork for your maintenance.”
אי נמי קטנה וספקה
The practical difference between them is the case of a woman who is of age but [the proceeds of whose handiwork] did not suffice [for her maintenance], or a minor [the proceeds of whose handiwork] is sufficient [for her maintenance].
תנן מי שהלך למדינת הים ואשתו תובעת מזונות חנן אמר תשבע בסוף ולא תשבע בתחלה נחלקו עליו בני כהנים גדולים ואמרו תשבע בתחלה ובסוף עד כאן לא פליגי אלא לענין שבועה אבל מזוני יהבינן לה תרגמה שמואל בששמעו בו שמת
We learned: If a man went to a country beyond the sea and his wife claimed maintenance: Hanan says: she must take an oath at the end but not at the beginning. The sons of the high priests differed from him and ruled that she must take an oath both at the beginning and at the end. They thus differ only in respect of the oath but they do not disagree that maintenance must be given to her? Shmuel explained [this to refer to a case] where they heard that he was dead.
תא שמע מי שהלך למדינת הים ואשתו תובעת מזונות בני כהנים גדולים אומרים תשבע חנן אומר לא תשבע ואם בא ואמר פסקתי לה מזונות נאמן
Come and hear: If [a husband] went to a country beyond the sea and his wife claimed maintenance: The sons of the High Priests say she must take an oath, Hanan said: She need not take an oath. If [the husband] came and declared, “I have provided for her maintenance,” he is believed.
הכא נמי בששמעו בו שמת והא אם בא ואמר קאמר אם בא לאחר שמועה
Here also [it may be replied] is a case where a report was received that he was dead. But did it not say, “If [the husband] came and declared…”? If he came after the report had been received.
ת"ש מי שהלך למדינת הים ואשתו תובעת מזונות ואם בא ואמר צאי מעשה ידיך במזונותיך רשאי קדמו בית דין ופסקו מה שפסקו פסקו הכא נמי בששמעו בו שמת
Come and hear: If [a husband] went to a country beyond the sea, and his wife claimed maintenance, and he returned and said [to her], “Deduct your handiwork for your maintenance,” he is permitted to say this. If the court granted the allowance before [he returned] their decision is valid. Here also it is a case where a report that he had died was received.
ת"ש מי שהלך למדינת הים ואשתו תובעת מזונות ב"ד יורדים לנכסיו וזנין ומפרנסין לאשתו אבל לא בניו ובנותיו ולא דבר אחר
Come and hear: If [a husband] went to a country beyond the sea and his wife claimed maintenance, the court sells some of his estate and provides food and clothing for his wife, but not for his sons and daughters or for anything else!
אמר רב ששת במשרה את אשתו ע"י שליש אי הכי בניו ובנותיו נמי כשהשרה לזו ולא השרה לזו מאי פסקא
Sheshet said; [Here it is a case] where a husband maintained his wife at the hands of an agent. If so, they should also provide for his sons and daughters? [It is a case] where [a husband] made provision for the maintenance for her but not for them. How can we be so certain?
אלא אמר רב פפא כששמעה בו שמת בעד אחד היא דאי בעית אינסובי בעד אחד מצי מינסבא מזוני נמי יהבינן לה
Rather R. Papa said, [The case] is where she heard from one witness that [her husband] had died. To her, since she could marry on the evidence of one witness, they also grant her maintenance;
בניו ובנותיו דאי בעו למיחת לנכסיו בעד אחד לא מצו נחתי מזוני נמי לא יהבינן להו
to his sons and daughters, since even if they wanted to take possession of his estate on the evidence of one witness they cannot, we also do not provide for them maintenance.
