Chapter 89

א סוקלין אותה על פתח בית אביה כלומר ראו גידולים שגידלתם באו לה עדים בבית אביה שזינתה בבית אביה סוקלין אותה על פתח שער העיר סרחה ולבסוף בגרה תידון בחנק
1 she is stoned at the door of her father’s house, as if to say, “See what you have raised.” If witnesses came [to testify] against her in her father’s house that she played the harlot in her father’s house she is stoned at the entrance of the gate of the city. If she committed adultery and then became of majority age, she is condemned to strangulation.
ב למימרא דכל היכא דאישתני גופא אישתני קטלא ורמינהי נערה המאורסה שזינתה ומשבגרה הוציא עליה שם רע הוא אינו לוקה ואינו נותן מאה סלע היא וזוממיה מקדימין לבית הסקילה
2 This implies that wherever there occurred a change in one’s body, the mode of execution is also changed. But they raise the following against this: If a betrothed young girl fornicated and after she reached majority age, her husband brought out a bad name against her, he is not flogged nor does he pay the hundred sela, but she and the witnesses who testified falsely against her are hurried to the place of stoning’?
ג היא וזוממיה ס"ד אלא או היא או זוממיה מקדימין לבית הסקילה
3 She and the witnesses who testified falsely against her! Rather she or her witnesses are hurried to the place of stoning.
ד אמר רבא מוציא שם רע קאמרת שאני מוציא שם רע דחידוש הוא דהא נכנסה לחופה ולא נבעלה בעלמא וזינתה בחנק ואילו מוציא שם רע בסקילה
4 Rava said: You referred to [the law about a husband] who brought out an evil name; the law of one who brings out an evil name is different,because it is an anomaly. For, in general, if a girl entered the bridal chamber and did not have intercourse, and then committed adultery, she is condemned to strangulation, but [a woman upon whom a husband] brought an evil name is condemned to stoning.
ה אמר ליה רב הונא בריה דרב יהושע לרבא דלמא כי חדית רחמנא היכא דלא אישתני גופא אבל היכא דאישתני גופא לא חדית רחמנא
5 Huna the son of R. Joshua said to Rava: Perhaps when the Torah created the anomaly it was only where her body had not changed, but where her body did change, the Torah did not make an anomaly.
ו אלא אמר רב נחמן בר יצחק אישתני ולא אישתני תנאי היא דתנן חטאו עד שלא נתמנו ונתמנו הרי הן כהדיוטות
6 Rather R. Nahman b. Yitzchak said: The question of whether a change in body effects a change in punishment is [a point of dispute between] Tannaim. For we have learned: If they transgressed before they were appointed, and afterwards they were appointed, they are regarded as regular people.
ז רבי שמעון אומר אם נודע להם עד שלא נתמנו חייבים משנתמנו פטורים
7 Rabbi Shimon said: if their sin came to their knowledge before they were appointed they are liable, but if after they were appointed they are exempt.
