הכי קאמר בית הכסא קבוע דליכא ניצוצות שרי בית הכסא עראי דאיכא ניצוצות אסרי

But this is what he means to say: They permit a regular privy where there is no splashing [of urine likely to defile the hand which holds the Tefillin], but they prohibit a chance privy where there is this likelihood.
