Commentary for Ketubot 81:7

סימן היזיק מה והמית כלל: תנן הניזק והמזיק בתשלומין בשלמא למאן דאמר פלגא ניזקא ממונא היינו דשייך ניזק בתשלומין אלא למ"ד פלגא ניזקא קנסא השתא דלאו דידיה קא שקיל בתשלומין איתיה

(Mnemonic: He damaged what, and killed a general rule.) We have taught: The plaintiff and the defendant are involved in the payment. This goes well for the one who holds that liability for half damages is compensation, that is why the plaintiff is involved in the payment, but according to the one who holds that liability for half damages is a penalty: If he receives that which really should not be his, how can he be involved in the payment?

The victim and the damager (share) in the payment - both of them lose in the matter, the initial logic is that this is what it is saying, both of them are touched (lit. reached) with this loss, the victim loses half and the damager half:
